Shelby County faces another FOIA lawsuit over unfulfilled record requests

Shelby County, Illinois, and the Shelby County Dive Team face a new lawsuit concerning alleged failures to respond adequately to Freedom of Information Act (FOIA) requests. The lawsuit claims that the county and its dive team did not properly address several FOIA requests for public records submitted between May 2024 and November 2024.

In Illinois, responding to public records requests is considered a "primary duty" as stated in the Illinois Compiled Statutes (5 ILCS 140/1). The requested documents pertained to copies of certain public records.

The outcome of this case may have implications for how public bodies in Illinois handle their obligations under FOIA legislation.
