Maryville board faces criticism over support for school tax referendum

The Village of Maryville has recently come under scrutiny for its actions related to a tax referendum. The village placed an advertisement on its electronic sign, encouraging voters to support a tax increase for the local school district. This action was followed by the village board's approval of a resolution supporting Collinsville Community School District #10’s tax referendum, which also urged residents to vote "YES."

In the resolution, the village described the proposed 44 percent tax increase as "modest." The document stated: “The Village of Maryville Board of Trustees urge all residents of the Village of Maryville to carefully consider the long-term benefits of supporting this Zero Tax Rate Change Proposal and to vote in favor of it in the upcoming election.”

However, these actions have raised legal concerns. According to the State Officials and Employees Ethics Act, which local governments are required to adopt, such electioneering is prohibited. The act defines "Prohibited Political Activity" and includes restrictions outlined in Section 5-15.

Maryville adopted an Ethics Ordinance in 2004 that aligns with this state law. By passing this resolution, the village board violated its own ordinance (Sec 1, para D) by engaging in activities deemed prohibited under the act. Furthermore, penalties from Section 50-5 of the act classify such violations as Class A Misdemeanors and could lead to discipline or discharge for those involved.
