State Representative Adam Niemerg (R-Dieterich) has vowed to continue the fight against the Illinois "gun ban" following a recent ruling by the 7th U.S. Circuit Court of Appeals. The court's decision, which came in a 2-1 split, reversed a lower-court injunction that had been imposed against the firearms restrictions in question.
Opponents of the gun ban, including Rep. Niemerg, argue that the measure violates the Second Amendment of the U.S. Constitution, which guarantees the right of individuals to "keep and bear arms."
"It is my hope this will be appealed to the federal supreme court where we will have a different outcome. I will continue to fight for and with law-abiding citizens and gun shop owners to preserve our Constitutional freedoms in Illinois," declared Rep. Adam Niemerg.

Niemerg is that the appellate panel referenced a U.S. Supreme Court opinion from last year, which struck down New York state's limits on carrying concealed handguns outside the home. "I am encouraged by the U. S. Supreme Court's decision last year that established a new legal test for gun restrictions. Upon appeal, this law should fall under the same umbrella of constitutional protection," added Rep. Niemerg.
