Shelby County faces questions over enforcement of court orders

On May 8, 2024, Judge Miller issued an order requiring a criminal defendant to comply with the Criminal Identification Act by May 10, 2024. Attorney Tom Finks appeared in court on the deadline date and reportedly attempted to have previous orders dismissed, but they remained intact.

A Freedom of Information Act (FOIA) request was submitted to the Sheriff's office on May 17, 2024, seeking a mug shot and booking documents related to this case. The request was denied due to claims that no records existed. It is understood that the defendant visited the Sheriff's office for compliance on May 10, but no paperwork was available for processing.

On July 1, 2024, nearly two months after the initial compliance deadline, a second FOIA request was filed in hopes that compliance had been achieved. Despite mug shots having a 72-hour deadline under FOIA regulations, the response received on July 9 indicated again that no records were available.

This situation raises questions about the enforcement of court orders in Shelby County.
