4.1 Ordinance No. 076-2023, An Ordinance Authorizing the Purchase of Real Estate - City Administrator Miller

City Administrator Miller stated this ordinance purchases 4.03 acres for $200,000 from K A, LLC. The property is located at the southeast corner of Avenue of Mid America and Outer Belt West directly across from the EPC and is currently improved with a parking lot.

Motion to pass by Commissioner Gillenwater, second by Commissioner Stephens Final Resolution: Motion Carried. 5-0

4.2 Ordinance No. 077-2023, An Ordinance Authorizing the Purchase of Real Estate (Schwerman Street, Effingham, Illinois) - City Administrator Miller

Mayor Schutzbach stated this item was pulled from the agenda.

4.3 Resolution No. 133-2023, A Resolution Authorizing Acceptance of a quote from Evoqua Water Technologies for the Emergency Repair at the Waste Water Treatment Plant - Public Works Director Heuerman

Public Works Director Heuerman stated this resolution accepts a quote from Evoqua Water Technologies in the total amount of $64,258.53 for the Emergency Repair at the Waste Water Treatment Plant. Payment for this project will be made from the Sewer Fund.

6. DISCUSSION

6.1 Ordinance No. 078-2023, An Ordinance Authorizing the Acquisition of a Temporary Use Permit and the Purchase of an Easement for Utility Purposes - Reynaldo and Marisol V. Gonzales - City Engineer Thoele

Items 6.1, 6.2, 6.3 and 6.4 were combined in discussion.

This ordinance authorizes the acquisition of a temporary use permit and the purchase of easement for utility purposes from Reynaldo and Marisol V. Gonzales at 610 W. Fayette Ave. for the sum of $2,312.40.

There were no objections to bring this item back to a future City Council Meeting.

6.2 Ordinance No. 082-2023, An Ordinance Authorizing the Acquisition of a Temporary Use Permit for Utility Purposes - Patricia A. Stock - City Engineer Thoele

This ordinance authorizes the acquisition of a Temporary Use Permit for utility purposes from Patricia A. Stock.

There were no objections to bring this item back to a future City Council Meeting.

6.3 Ordinance No. 083-2023, An Ordinance Authorizing the Acquisition of a Temporary Use Permit and the Purchase of an Easement of Utility Purposes - Lois K. Zwettler - City Engineer Thoele

This ordinance amends Ordinance No. 063-2023. The amount stays the same, but the agreement commits to reconstructing the sanitary service line for this property so that sewage is directed to the new Fayette sewer. The sum of $4,659.12 is unchanged.

6.4 Ordinance No. 081-2023, An Ordinance Authorizing Purchase of Real Property for Utility Purposes - Richard S. Stock - City Engineer Thoele

This ordinance authorizes the acquisition of a temporary use permit and the purchase of an easement for utility purposes from Richard S. Stock for the sum of $1,418.25.

6.5 Ordinance No. 080-2023, An Ordinance in Relation to Tax Levy for the City of Effingham, Illinois - City Administrator Miller

City Administrator Miller stated the draft FY25 Tax Levy will be presented to the Council for consideration. The rate that was proposed was 3.5%. The levy is based on an EAV of $399,672,121.

6.6 Resolution No. 136-2023, A Resolution Concerning Ordinance No. 052-2012, an Ordinance Authorizing the Issuance of General Obligation Refunding Bonds (Alternate Revenue Source) Series 2012c, of the City of Effingham, Effingham County, Illinois, Directing the Application of Funds to the Payment of Debt and Directing the Abatement of a Levy and Extension of Taxes for the year 2023 Previously Established to pay such Bonds (2012C Series) - City Administrator Miller

Items 6.6, 6.7, 6.8, and 6.9 were combined in discussion.

The 2012c Series Bonds were issued in association with construction of the raw water line built from Holland Regional Water System (HRWS) as an alternate water source. Debt certificates were initially issued in 2006, although the debt was refinanced with the 2012c Series Bond at a lower rate. The bond expires in 2026 and payments are made by the water department.

There were no objections to bring this item back to a future City Council Meeting.

6.7 Resolution No. 137-2023, A Resolution Concerning Ordinance No. 104-2016, An Ordinance Authorizing the Issuance of General Obligation Bonds (Alternate Revenue Source), Series 2017, of the City of Effingham, Effingham County, Illinois, Directing the Application of Funds to the Payment of Debt and Directing the Abatement of a Levy and Extension of Taxes for the Year 2023 Previously Established to Pay Such Bonds- City Administrator Miller

The 2017 Series Bond is primarily associated with construction of the Police Station, and construction of other public facilities. The Bond expires in 2036. Yearly debt payments are made from the General Fund.

6.8 Resolution No. 138-2023, A Resolution Concerning Ordinance No. 004-2021, an Ordinance Authorizing the Issuance of General Obligation Refunding Bonds (Alternate Revenue Source), Series 2021A, of the City of Effingham, Effingham County, Providing for the Details of Such Bonds and for an Alternative Revenue Source and Directing the Application of Funds to the Payment of Debt and Directing the Abatement of a Levy and Extension of Taxes for the Year 2023 Previously Established to Pay Such Bonds (2021A Series) - City Administrator Miller

The 2021A Series Bond was issued to refinance the Effingham Performance Center (EPC) building. The bond expires in 2027. Yearly debt payments are made from the Tourism Fund.

6.9 Resolution No. 139-2023, A Resolution Concerning Ordinance No. 005-2021, An Ordinance Authorizing the Issuance of General Obligation Refunding Bonds (Alternate Revenue Source), Series 2021B, of the City of Effingham, Effingham County, Illinois, Providing the Details of Such Bonds and for an Alternate Revenue Source and Directing the Application of Funds to the Payment of Debt and Directing the Abatement of a Levy and Extension Of Taxes For The Year 2023 Previously Established To Pay Such Bonds (Series 2021B)- City Administrator Miller

The 2021B Series Bond was issued to purchase 154 acres of undeveloped land along South Route 45. The bond expires in 2040. Yearly debt payments are made from the General Fund.

There were no objections to bring this item back to a future City Council Meeting. 6.10 2023 Pavement Marking Program - Change Order No. 1 - City Engineer Thoele

Public Works Director Heuerman stated Change order No. 1 extends the completion date to 5/30/2024, which is recommended to allow work to be completed in the spring.

Economic Development Director Hull stated the City is considering adopting a TIF housing rehabilitation program. The program would follow the fiscal year with a budget of $100,000. It would be exterior improvements with projects being a minimum of $10,000. Funding would be for 25% or $25,000. This would apply to the life of the home.

Economic Development Director Hull stated the Enterprise Zone Annexation Application was approved.

Police Chief McFarland stated they are hiring a new officer
