Edgar County has filed a motion to dismiss in response to an ongoing complaint by Rides Mass Transit District (Rides MTD) over the distributions of funds following the dissolution of the East Central Mass Transit District.
According to a report by the Edgar County Watchdogs, which first covered the funds dispute in 2013, the motion argues several points, including insufficient facts presented by Rides MTD to support an enforceable contract.
The complaint stems from resolutions adopted by both the Edgar County Board of Commissioners and Rides MTD in June 2013. Edgar County resolved to be annexed into the East Central Mass Transit District and agreed that all assets received by the Edgar County treasurer following the dissolution of the district would be transferred, assigned and conveyed as the county’s contribution to Rides MTD.
The Rides MTD resolution approved the annexation of Edgar County. The county treasurer received $152,000 following the district's dissolution, which it has not transferred to Rides MTD.
Rides MTD filed a complaint in August 2016, which was dismissed in January for failing to state a claim for breach of contract. It then filed a two-count amended complaint on February 9, which the county is seeking to have dismissed with its recent motion.
