Village of Montgomery Board of Trustees met July 28.

Here are the minutes provided by the board:

I. In the absence of President Brolley, President Pro Tem Theresa Sperling called the meeting to order at 7:00 p.m. followed by the Pledge of Allegiance.

II. Roll Call

III. Public Participation

A. Water Treatment Plant Videos - Manager Nemetz introduced two videos, one featuring Water Treatment Plant Operator Jason Carey explaining the water treatment process, and one featuring Water Billing Clerk Linda Ebinger explaining possible causes of high-water bills and how to check for leaking toilets. These will help with public education and will be used for public outreach at this year’s Montgomery Fest.

B. Public Comment – Annie Story from ILAWWA presented the Gold Ambassador Award to the Village of Montgomery to recognize the important outreach work being done in the community. Adam Pauli, VP of Kane County Regional Board of Trustees, spoke on the importance of the 988 suicide prevention campaign and the necessity of having Narcan available in each community.

A. Minutes of the July 14, 2025, Village Board Meeting

B. Minutes of the July 14, 2025 Executive Session

C. Accounts Payable Summary Report through July 28, 2025, in the Amount of $1,500,598.30

D. Refuse Report for June 2025

E. Request for Liquor License Class J and Waiver of Temporary Liquor License Fee for the Conservation Foundation for Beers, Bands and Barns

F. Appointment of Linda L. Barnes to the Historic Preservation Commission

Trustee Brzoska moved to approve Items A-F of the Consent Agenda, seconded by Trustee Jungermann.

V. Items for Separate Action

A. Ordinance 2140 Regulating Public Camping (Second Reading)

Trustee Marecek moved to approve Ordinance 2140 Regulating Public Camping (Second Reading), seconded by Trustee Jungermann.

B. Resolution 2025-021 Approving an Amendment to The Montgomery Development Fund Programs for The Village of Montgomery

Attorney Quance said the Village cannot provide public funds without requiring prevailing wages; however, applicants could apply for a portion of their project, and she would recommend that the final part is paid for with Village funds to ensure the entire project is completed. Trustee Sperling suggested that the low-interest loan program should say work cannot begin until they receive notice in writing that their application is approved.

Trustee Marecek moved to approve Resolution 2025-021 Approving an Amendment to The Montgomery Development Fund Programs for The Village of Montgomery, seconded by Trustee Jungermann.

6 Yea. 0 No. Motion carried. Trustee Marecek, Trustee Brzoska, Trustee Gier, Trustee Sperling, Trustee Bauman and Trustee Jungermann voting yea.

C. Ordinance 2141 Declaring Personal Property Owned by The Village Surplus and Authorizing Its Disposal (Waiver of First and Passage on Second Reading)

Director Wolf said these are items that are no longer being used and will be listed for sale on an auction site. Trustee Gier noted the need to make sure the SCADA equipment doesn’t have any personal information on it and Director Wolf stated that will be done.

Trustee Gier moved to approve Ordinance 2141 Declaring Personal Property Owned by The Village Surplus and Authorizing Its Disposal (Waiver of First and Passage on Second Reading), seconded by Trustee Jungermann.

D. Resolution 2025-022 Authorizing Village Administrator to sign IEPA SRF Loan Documentation Engineer Ott explained that the Village has received and will continue to receive documents for the water project loans and this will provide authorization for Administrator Zoephel to sign current and future loan documents.

Trustee Marecek moved to approve Resolution 2025-022 Authorizing Village Administrator to sign IEPA SRF Loan Documentation, seconded by Trustee Gier.

E. Resolution 2025-023 Authorizing the Acceptance of Public Improvement and Bond Reduction (Karis Center for Commerce)

Director Abt stated that Karis has completed the public improvements and is requesting their bond be reduced. Staff recommends the reduction with a landscape bond remaining for one year.

Trustee Brzoska moved to approve Resolution 2025-023 Authorizing the Acceptance of Public Improvement and Bond Reduction (Karis Center for Commerce), seconded by Trustee Marecek.

F. Resolution 2025-024 Authorizing an Intergovernmental Agreement between the Village of Montgomery and the Oswego Fire Protection District Regarding the Transfer and Conveyance of Real Property

Director Abt reviewed that in 2024 the Oswego Fire Protection District requested some land adjacent to their facility which the Village owns and intends to transfer to them to expand their training facilities.

Trustee Marecek moved to approve Resolution 2025-024 Authorizing an Intergovernmental Agreement between the Village of Montgomery and the Oswego Fire Protection District Regarding the Transfer and Conveyance of Real Property, seconded by Trustee Brzoska.

G. Ordinance 2142 Amending Village Code 3-7 and 3-9 To Create and Grant a Class K-2 Liquor License (Schaefer’s Greenhouses - 120 S. Lake Street) (Waiver of First and Passage on Second Reading)

Director Abt summarized Schaefer’s request for a pour license as well as to sell package liquor. Since the Board had concerns about issuing Class A and C licenses, this ordinance creates a Class K-2 license specifically for florists. Billy Murdoch stated no small bottles of alcohol will be sold as they want it to be a family-friendly place.

Trustee Jungermann moved to approve Ordinance 2142 Amending Village Code 3-7 and 3-9 To Create and Grant a Class K-2 Liquor License (Schaefer’s Greenhouses - 120 S. Lake Street.) (Waiver of First and Passage on Second Reading), seconded by Trustee Bauman.

H. PSA for 2026 Infrastructure Road Program – Design Engineering

Engineer Ott said this is for crack sealing as well as asphalt removal and replacement. They want to start the design process for the areas identified in the five-year plan so they can go to bid in January and award in February.

Trustee Gier moved to approve PSA for 2026 Infrastructure Road Program – Design Engineering, seconded by Trustee Marecek.

I. PSA for 2026 Water Main Improvement Project (S. River Street) – Design Engineering Director Wolf said water reduction loss auditing identified this area and found the removal of two auto flushers will help reduce water loss. The Village is at 15% water loss currently; after removing those it should be down to 10.7% loss. Staff wants to go ahead with the design in order to have a shovel-ready project in case state funding is available. Trustee Gier asked several questions regarding the dead ends on Case and Jefferson, and Engineer Ott explained the watermain will loop around and back up on River Street in order to help water flow and quality.

Trustee Gier moved to approve PSA for 2026 Water Main Improvement Project (S. River Street) – Design Engineering, seconded by Trustee Brzoska.

J. Resolution 2025-025 Authorizing the Acceptance of Public Improvement and Bond Reduction (Ravago)

Director Abt stated the Ravago project is complete and the public improvements are done, so they want to reduce the bond. Staff recommends this, but will hold the landscaping bond in full for another year.

Trustee Jungermann moved to approve Resolution 2025-025 Authorizing the Acceptance of Public Improvement and Bond Reduction (Ravago), seconded by Trustee Marecek.

VII. New or Unfinished Business

Trustee Jungermann asked when the traffic study on Concord will be done. Engineer Ott said by the next Board meeting. He also reported a resident said the sidewalk in front of 2600 Caliendo Circle buckled from the heat.

Trustee Gier said he got a call from a resident in Parkview complaining about the Crown Street ditch line that has steep sides and is hard to maintain. He said Director Wolf and Shawn Murphy came up with a plan and got it cleaned up. The resident said it looks so good and she really appreciates how quickly they got it done. Director Wolf said they will look for a long-term solution for that area.

Trustee Brzoska said several trees came down in the latest storm and Public Works provided an awesome response, with an additional brush pick-up on Tuesday.
