Pecatonica township files lawsuit against clerk over election conduct

Pecatonica Township, Illinois - The Pecatonica Township Electoral Board has initiated legal proceedings against Township Clerk Kelly Olson Fuca. The lawsuit alleges that Fuca showed favoritism by removing certain candidates from the ballot without an electoral board hearing.

The complaint was filed on February 24, 2025, in the circuit court for the 17th judicial circuit, Winnebago County, Illinois. It was submitted by Pecatonica Township and its Township Supervisor Elizabeth Leigh Clark, along with Vernell Sarver, who is a member of the Pecatonica Township Officers Electoral Board.

The lawsuit comprises three counts and aims to compel Clerk Fuca to apply uniform treatment to all candidates vying for positions in Pecatonica Township. According to the suit, six candidates did not provide receipts to the Township Clerk’s office showing they had filed statements of economic interests with the Winnebago County Clerk’s office. Filing these receipts is a requirement for candidacy.
