City of Olney Board of Appeals met Oct. 7.

AGENDA #1 “CALL TO ORDER” The October 7, 2024, meeting of the Board of Appeals was called to order at 7:00 p.m. in the Council Chambers of the Olney City Hall, 300 S. Whittle Avenue, Olney, Illinois, by David Abell.
AGENDA #2 “ROLL CALL” The following Board of Appeals members were present: Kurt Ginder, Scott Jones, Brad Williams, Samantha Brazil, and David Abell. Bridgett Jensen and Pat Everette were absent. Also present were City Clerk Kelsie Sterchi, and Code Enforcement Officer Dallas Colwell.
AGENDA #3 “APPROVE MINUTES OF THE BOARD OF APPEALS MEETING ON SEPTEMBER 3, 2024” Mr. Jones moved to approve the minutes from September 3, 2024, seconded by Mrs. Brazil. Mr. Ginder, Mr. Jones, Mr. Williams, Mrs. Brazil, and Mr. Abell voted yes. There were no opposing votes. The motion carried.
AGENDA #4 “SWEARING IN” Mr. Abell asked that anyone wishing to testify on behalf of the items being discussed to stand and be sworn in. City Clerk Sterchi asked the individual to stand, raise her right hand, and “swear to tell the truth, the whole truth and nothing but the truth so help me God.” Susan Stark was sworn in.
AGENDA #5 “PUBLIC HEARING: VARIANCE REQUEST FOR 307 N. OHIO STREET” Susan J. Stark had submitted a Request for Variation for 307 N. Ohio Street, Olney, Illinois, Property Index Number 06-35-319-005. The petitioner requested a variance to allow for a 3-foot side yard setback rather than the 6-foot side yard setback as required in Title 17 (Zoning) of the City of Olney Municipal Code. The granting of the variance would allow the petitioner to add on a lean-to carport to her home.
The City Clerk had not received any comments for or against the request.
Mrs. Stark told the Board that she had limited space between her house and her property line, but was in need of this proposed carport. Even so, there was plenty of space between her property and the actual house to the north. The neighbor’s driveway was also on the north side of their property.
Mr. Abell asked if Mr. Colwell had anything to add. Mr. Colwell confirmed setback distances.
AGENDA #6 “VARIANCE: 307 N. OHIO STREET” Mr. Jones moved to approve a variance that would allow for a 3-foot side yard setback for 307 N. Ohio Street, seconded by Mr. Ginder. Mr. Ginder, Mr. Jones, Mr. Williams, Mrs. Brazil, and Mr. Abell voted yes. There were no opposing votes. The motion carried.
Mrs. Stark asked when she could begin work on the carport. Mr. Colwell advised that she could apply for a building permit the next day and would likely be approved to begin work next week.
Mr. Abell noted that the need for the proposed use was justifiable.
AGENDA #7 “PUBLIC COMMENTS/PRESENTATIONS” There were no comments.
AGENDA #8 “ADJOURN” Mr. Ginder moved to adjourn, seconded by Mr. Jones. Mr. Ginder, Mr. Jones, Mr. Williams, Mrs. Brazil, and Mr. Abell voted yes. There were no opposing votes. The motion carried.
The meeting of the Board of Appeals adjourned at 7:05 p.m.
