Mayor faces lawsuit over liquor license denial amid allegations of bias

In Rochester, Illinois, Mayor Joseph Suerdieck and the Village of Rochester are facing a federal civil rights lawsuit filed by Henry’s On Main, LLC. The business has accused them of violating civil rights related to free speech, petitioning for redress of grievances, and equal protection.

The legal action began in February 2024 when Henry’s On Main alleged that Suerdieck improperly denied a liquor license to their business. This denial allegedly occurred at a location where the mayor's son previously operated a business with such a license. The complaint suggests that the village president acted out of personal interest since his son's business was evicted for failing to pay rent and other obligations.

The court recently refused Suerdieck’s motion to dismiss the case, requiring him and the village to respond to the complaint within two weeks. The lawsuit seeks over $50,000 for each count from the defendants.

Statements from the complaint describe actions by Suerdieck as showing "sheer vindictiveness" and "substantial animus" toward Henry’s On Main. It further claims that Suerdieck harassed the plaintiff with intentions linked to personal gain.
