Shelby County faces penalties over delayed financial report

Shelby County has been informed by the Illinois Comptroller of a delinquency in its fiscal year 2023 Annual Financial Report (AFR). The notification stated, “This notice is to inform you that the fiscal year 2023 Annual Financial Report (AFR) for your unit of local government is currently delinquent.”

Local governments are required to submit their AFRs by October 31, 2024. Failure to meet this deadline will result in being omitted from the report card and listed as delinquent. This communication was initially sent to the Clerk and then distributed to the entire board.

Without a completed audit for 2023, Shelby County risks being placed on the delinquent list for publication. The Illinois Comptroller has authority over financial penalties for overdue filings. According to section 4(c) of the law: “The State Comptroller may grant extensions for delinquent audits or reports. The Comptroller may charge a governmental unit a fee for a delinquent audit or report of $5 per day for the first 15 days past due, $10 per day for 16 through 30 days past due, $15 per day for 31 through 45 days past due, and $20 per day for the 46th day and every day thereafter.” These fees can be adjusted at the discretion of the Comptroller and are deposited into the Comptroller’s Administrative Fund.
