City of Flora City Council met Nov. 13.

Here are the minutes provided by the council:

I. In the absence of President Brolley, President Pro Tem Sperling called the meeting to order at 7:01 p.m. followed by the Pledge of Allegiance led by Chief Phil Smith.

III. Public Participation

A. Proclamation for Diabetes Awareness Month (November).

Trustee Bauman joined the meeting at 7:03pm and read the proclamation, which was then approved by voice vote.

B. Tax Levy Announcement.

Director Milewski presented information on the tax levy and said the Public Hearing will be November 27th. The Village is allowed to levy CPI or 5% whichever is greater, and staff is looking for direction as to the amount of the levy for the November 27th Board Meeting.

C. Public Comments (Two Minute Opportunity). None

IV. Consent Agenda

A. Minutes of the October 23rd Village Board Meeting.

B. Executive Session Minutes of the October 23rd Village Board Meeting.

C. Accounts Payable through November 13th, 2023 in the Amount of $2,185,105.99.

D. Accounts Receivables for October 2023.

E. Building Report for October 2023.

F. Water Production Report for October 2023.

G. Reappointments and Two New Appointments for the Beautification Committee Members.

Trustee Marecek moved to approve Items A-G of the Consent Agenda, seconded by Trustee Jungermann.

5 Yea. 0 No. Motion carried. Trustee Marecek, Trustee Gier, Trustee Sperling, Trustee Bauman and Trustee Jungermann voting yea.

V. Items for Separate Action

A. Resolution 2023-031 Authorizing the Renewal of an Intergovernmental Agreement for Animal Control Services with Kane County.

Administrator Zoephel explained that for many years Metro West has negotiated an IGA for animal control services through Kane County and is asking for a letter of interest if the Village of Montgomery would like to participate again. This is for all of Montgomery including the Kendall County portion.

Trustee Marecek moved to approve Resolution 2023-031 Authorizing the Renewal of an Intergovernmental Agreement for Animal Control Services with Kane County. Trustee Jungermann seconded this motion.

5 Yea. 0 No. Motion carried. Trustee Marecek, Trustee Gier, Trustee Sperling, Trustee Bauman and Trustee Jungermann voting yea.

B. Recommendation of the Planning and Zoning Commission on PZC 2023-015 Variance (1330 Hinckley Street).

Director Abt stated this variance request is to allow a carport in the resident’s front yard, which technically meets the definition of a gazebo, to protect her vehicle. There is no feasible space in the rear or side yard for this. The UDO doesn’t specifically address carports, so staff is working on a text amendment to add a provision for carports. Trustee Sperling suggested that the variance should run with the owner of record and expire if the property is sold, but Director Abt said currently variances run with the land and are permanent. Trustee Gier requested a copy of how carports were addressed previously in the zoning code.

Trustee Marecek moved to approve Recommendation of the Planning and Zoning Commission on PZC 2023-015 Variance (1330 Hinckley Street). Trustee Jungermann seconded this motion.

5 Yea. 0 No. Motion carried. Trustee Marecek, Trustee Gier, Trustee Sperling, Trustee Bauman and Trustee Jungermann voting yea.

C. Ordinance 2045 granting a Variance from Section 9 of the Village’s Unified Development Ordinance (1330 Hinckley Street) (First Reading).

This is First Reading only and will not be on the Consent Agenda at the next meeting.

D. Resolution 2023-032 Authorizing the Acceptance of Public Improvements and Bond Reduction (Montgomery Place Apartments).

Director Abt said this resolution would authorize the further reduction of the bond but would keep 10% on reserve for landscaping and plants that are still in the maintenance period.

Trustee Marecek moved to approve Resolution 2023-032 Authorizing the Acceptance of Public Improvements and Bond Reduction (Montgomery Place Apartments), seconded by Trustee Jungermann.

5 Yea. 0 No. Motion carried. Trustee Marecek, Trustee Gier, Trustee Sperling, Trustee Bauman and Trustee Jungermann voting yea.

E. Approval of the 2023-2024 Motor Fuel Tax Resolution for Snow Removal Materials.

Director Wolf reviewed the resolution and plans to purchase salt and deicing materials for 2023/2024. The cost is roughly $1 more per ton than last year.

Trustee Jungermann moved to approve the 2023-2024 Motor Fuel Tax Resolution for Snow Removal Materials, seconded by Trustee Gier.

5 Yea. 0 No. Motion carried. Trustee Jungermann, Trustee Marecek, Trustee Gier, Trustee Sperling and Trustee Bauman voting yea.

VII. New or Unfinished Business

Trustee Jungermann complimented Public Works on the new truck, which he saw last week. Trustee Marecek congratulated Public Works on leaf collection which has been going very well this year. Director Wolf announced leaf collection is being extended up to December 1st.

Trustee Gier thanked Trustees Jungermann and Marecek for helping with Halloween decoration judging, and said they gave out almost 100 awards. He also announced that work on Blackberry Crossing West Park has finally begun. Trustee Bauman also said leaf pickup has been going well.

Trustee Sperling thanked Director Wolf for overseeing the work at Orchard and Route 30. The lights are up and working well. Trustee Jungermann also expressed thanks.

VIII. Future Meeting Schedule

A. Committee of the Whole Meeting– Tuesday, November 21, 2023 – “to be cancelled”.

B. Intergovernmental Committee – Monday, November 27, 2023 at 6:00P.

C. Village Board Meeting – Monday, November 27, 2023 at 7:00P.

IX. Executive Session:

A. To Discuss the Employment of an Employee Pursuant to 5 ILCS 120/2 (c)(1).

X. Adjournment: 7:23 p.m.

Trustee Jungermann moved to adjourn to Executive Session. Trustee Bauman seconded this motion.
