Village of Montgomery Board of Trustees met Oct. 23.

Here are the minutes provided by the board:

I. President Brolley called the meeting to order at 7:01 p.m. followed by the Pledge of Allegiance.

II. Roll Call

Also present: Village Administrator Jeff Zoephel, Attorney Laura Julien, Director of Community Development Sonya Abt, Director of Public Works Mark Wolf, Director of Finance Jennifer Milewski, Chief Phil Smith, Communications Manager Kristina Nemetz, Manager of Economic Development Patrick Burke, Engineer Peter Wallers, Engineer Chris Ott, Members of the Press and guests.

III. Public Participation

A. Lauterbach & Amen present the FY2023 Audit.

Jennifer Martinson presented the audit results to the Board. She explained that the Village received a clean audit opinion, the highest that can be issued. President Brolley asked for a copy of the Management Letter that she referenced.

B. Resident from Mayfield Drive.

Rob van het Hof, 2391 Mayfield Drive, requested a permanent solution to traffic violating the partial/ temporary closure on Mayfield Drive. President Brolley said staff will review and bring the topic back to the Board for discussion and advise him of the results.

Trustee Bauman joined the meeting at 7:10pm.

C. Public Comments (Two Minute Opportunity). None

IV. Consent Agenda

A. Minutes of the October 9th Village Board Meeting.

B. Executive Session Minutes of the October 9th Village Board Meeting.

C. Accounts Payable through October 23rd, 2023 in the Amount of $1,249,415.05.

D. Refuse Report for September 2023.

Trustee Jungermann moved to approve Items A-D of the Consent Agenda, seconded by Trustee Bauman.

6 Yea. 0 No. Motion carried. Trustee Jungermann, Trustee Marecek, Trustee Betsinger, Trustee Gier, Trustee Sperling and Trustee Bauman voting yea.

V. Items for Separate Action

A. Ordinance 2042 Granting a Special Use (Multi-Unit Dwellings) and Variations from Section 8 of the Village's Unified Development Ordinance (160 Sherman Ave.) (Second Reading).

Trustee Gier asked and Director Abt confirmed that no penalties or fees are being waived.

Trustee Gier moved to approve Ordinance 2042 Granting a Special Use (Multi-Unit Dwellings) and Variations from Section 8 of the Village's Unified Development Ordinance (160 Sherman Ave.) (Second Reading). Trustee Marecek seconded this motion.

6 Yea. 0 No. Motion carried. Trustee Gier, Trustee Sperling, Trustee Bauman, Trustee Jungermann, Trustee Marecek and Trustee Betsinger voting yea.

B. Professional Services Agreement with Engineering Enterprises, Inc. in the amount of $84,066.00 for Coordination with Waterlink Partners and Stantec for the Development and Preparation of the WIFIA application.

Director Wolf said in working toward Lake Michigan water, this PSA will allow EEI to coordinate with Waterlink partners and prepare the Village’s WIFIA application.

Trustee Gier moved to approve Professional Services Agreement with Engineering Enterprises, Inc. in the amount of $84,066.00 for Coordination with Waterlink Partners and Stantec for the Development and Preparation of the WIFIA application. Trustee Betsinger seconded this motion.

6 Yea. 0 No. Motion carried. Trustee Gier, Trustee Sperling, Trustee Bauman, Trustee Jungermann, Trustee Marecek and Trustee Betsinger voting yea.

C. Approval of Purchase from Aurora Sign Co. for the Village of Montgomery Gateway Signage Project Year One in the Amount of $24,984.00.

Manager Nemetz reported that money is budgeted annually for six years for gateway signage. 18 signs with the rebranded Village logo are proposed to be installed as Phase 1.

Trustee Gier moved to approve Approval of Purchase from Aurora Sign Co. for the Village of Montgomery Gateway Signage Project Year One in the Amount of $24,984.00, seconded by Trustee Jungermann.

6 Yea. 0 No. Motion carried. Trustee Gier, Trustee Sperling, Trustee Bauman, Trustee Jungermann, Trustee Marecek and Trustee Betsinger voting yea.

D. Resolution 2023-030 Approving a Memorandum of Understanding Between the Village of Montgomery and A.&A. Conte Joint Venture Limited Partnership.

Attorney Julien stated that the Conte Annexation Agreement will expire this week which contained a clause regarding a land donation to the Village. This MOU memorializes each party’s intent regarding that land donation. Engineer Wallers said the land will be used for a future receiving station for Lake Michigan water with an elevated storage facility and metering station. Attorney Julien noted that the actual transfer of the land will come back before the Board to accept the land. Trustee Betsinger stated he will vote no because the Board was not given the final resolution before this evening.

Trustee Gier moved to approve Resolution 2023-030 Approving a Memorandum of Understanding Between the Village of Montgomery and A.&A. Conte Joint Venture Limited Partnership, seconded by Trustee Bauman.

5 Yea. 1 No. Motion carried. Trustee Gier, Trustee Sperling, Trustee Bauman, Trustee Jungermann and Trustee Marecek voting yea. Trustee Betsinger voting no.

VI. Items for Discussion

A. Snow and Ice Plan Update 2023.

Director Wolf presented a PowerPoint summarizing the 2023 Snow plan. Anti-icing and de-icing efforts will continue this year, as will tandem plowing. A second truck was approved which will be delivered next week for anti-icing. The entire plan is always reviewed and updated each year to ensure they can keep roadways and facilities safe. Trustee Bauman asked if there is an ordinance that trash containers should not be placed in streets because it’s an obstacle for cars. Director Wolf said he will find out, as it causes issues for leaf pickup as well as snow plowing.

VII. New or Unfinished Business

Trustee Gier mentioned Wednesday at 5:30pm is judging for Halloween decorations. Trustee Marecek reminded everyone that the Halloween Safety Event is 10am-2pm this Sunday and thanked the PD for planning the event. Trustee Jungermann asked about the schedule for Route 30/Orchard. Director Wolf said the signal cabinet was installed and testing will be November 3rd. The last items to be installed are some reflectors in the road. Engineer Ott said generic timing of the signals will be used initially, but a consultant will come and optimize the signals over the next week.

B. Beautification Committee – Wednesday, November 8, 2023 at 6:00P.

A. To Discuss the Employment of an Employee Pursuant to 5 ILCS 120/2 (c)(1).
