3. PRESENTATIONS

3.1 Firefighter Statue - Commissioner Moeller

Commissioner Moeller provided information on the fundraising project in memory of the St. Anthony Hospital fire and requested the Council consider contributing $15,000.

This item will be brought back to a future City Council Meeting.

4. ORDINANCES/RESOLUTIONS - ACTION ITEMS

4.1 Ordinance No. 053-2023, An Ordinance Amending Appointment Ordinance No. 011- 2023, An Ordinance Establishing Pay Ranges for the Various Non-Union Salaried and Hourly Positions - City Administrator Miller

City Administrator Miller stated this ordinance amends the Fiscal Year 2024 Pay Plan to accommodate the City Treasurer's appointment.

Motion to pass by Commissioner Stephens, second by Commissioner Moeller Final Resolution: Motion Carried. 5-0

4.2 Ordinance No. 052-2023, An Ordinance Amending Appointment Ordinance No. 019- 2023 - City Administrator Miller

Deputy City Administrator Presley introduced Bridget Polk and stated this ordinance amends Ordinance No. 019-2023 to appoint her as City Treasurer.

Motion to pass by Commissioner Moeller, second by Commissioner Stephens Final Resolution: Motion Carried. 5-0

4.3 Ordinance No. 043-2023, An Ordinance Amending the Zoning Ordinance of the City of Effingham, RLM Assets, LLC and GLD Holdings, LLC - Rezone from NU Nonurban and M-1 Light Industrial District to R-3D Multiple-Dwelling District - Miracle Avenue - City Planner Koester

Motion to pass by Mayor Schutzbach, second by Commissioner Moeller Final Resolution: Motion Failed.

4.4 Resolution No. 092-2023, A Resolution Granting Permission to Effingham High School to have an Effingham High School Homecoming Parade on Wednesday, September 27, 2023 - Tourism Director Thoele

Tourism Director Thoele stated this resolution grants permission to EHS to have the EHS Homecoming Parade on September 27, 2023.

Motion to adopt by Commissioner Micenheimer, second by Commissioner Gillenwater Final Resolution: Motion Carried. 5-0

4.5 Resolution No. 096-2023, A Resolution Authorizing Acceptance of Proposal from Kinney Contractors for the 2023 Pavement Patching Program - City Engineer Thoele

Public Works Director Heuerman stated this resolution accepts a proposal from Kinney Contractors Inc. in the total amount of $312,461 for the 2023 Pavement Patching Program.

Motion to adopt by Commissioner Moeller, second by Commissioner Stephens Final Resolution: Motion Carried. 5-0

4.6 Resolution No. 097-2023, A Resolution Authorizing Acceptance of Proposal from Varsity Striping & Construction Co. for the 2023 Pavement Marking Program - City Engineer Thoele

Public Works Director Heuerman stated this resolution accepts a proposal from Varsity Striping & Construction Co. in the total amount of $188,508.57 for the 2023 Pavement Marking Program.

Motion to adopt by Commissioner Gillenwater, second by Commissioner Stephens Final Resolution: Motion Carried. 5-0

4.7 Resolution No. 098-2023, A Resolution Authorizing Acceptance of Proposal from Effingham Asphalt for the 2023 Resurfacing Program Phase 2 - City Engineer Thoele

Public Works Director Heuerman stated this resolution accepts a proposal from Effingham Asphalt in the total amount of $379,406. for the 2023 Resurfacing Project Phase 2.

Motion to adopt by Commissioner Micenheimer, second by Commissioner Moeller Final Resolution: Motion Carried. 5-0

6. DISCUSSION

6.1 Ordinance No. 046-2023, An Ordinance Amending Chapter 4 of the Municipal Code of the City of Effingham, Illinois (Liquor Control) - Mayor Schutzbach

City Attorney Willenborg stated this ordinance changes the language concerning liquor delivery permits. The change of no fee for Delivery Permit is consistent with State of Illinois Liquor Control regulations. Deliverers may be 18 years of age as described in this ordinance.

Following discussion, it was noted the age would be changed to 21 years of age. A revised ordinance will be brought back to a future City Council Meeting.

6.2 Ordinance No. 047-2023, An Ordinance Authorizing the Acquisition of a Temporary Use Permit and the Purchase of Easements for Utility Purposes - Harden Easement - City Engineer Thoele

6.3 Ordinance No. 048-2023, An Ordinance Authorizing the Acquisition of a Temporary Use Permit and the Purchase of Easements for Utility Purposes - Olga Cristina Lira - City Engineer Thoele

6.4 Ordinance No. 049-2023, An Ordinance Authorizing the Acquisition of a Temporary Use Permit and the Purchase of Easements for the Utility Purposes - Family Pregnancy Life Center, Inc. - City Engineer Thoele

6.5 Ordinance No. 050-2023, An Ordinance Authorizing the Acquisition of a Temporary Use Permit and the Purchase of Easement for Utility Purposes - Family Life Pregnancy Center, Inc. - City Engineer Thoele

6.6 Ordinance No. 051-2023, An Ordinance Authorizing the Acquisition of a Temporary Use Permit and the Purchase of Easement for Utility Purposes - Lawrence R. & Lucille J. Buhnerkempe Revocable Living Trust - City Engineer Thoele

Items 6.2, 6.3, 6.4, 6.5, and 6.6 were combined in discussion.

All will be brought back to a future City Council Meeting.

6.7 Resolution No. 093-2023, A Resolution Granting Permission to Allow Village Wine to have Effingham Cruise Night in Downtown Effingham and to Allow Certain Temporary City Street Closures for Said Public Event - Tourism Director Thoele

Tourism Director Thoele stated this resolution grants permission to allow Village Wine to have Effingham Cruise Night on September 9, 2023, in Downtown Effingham.

There were no objections to bring this item back to a future City Council Meeting.

6.8 Resolution No. 094-2023, A Resolution Granting Permission to Allow a Portion of City Streets and Public Parking Lots to be Temporarily Closed for Corvette Welcome Fest - Tourism Director Thoele

Tourism Director Thoele stated this resolution grants permission to allow City streets to be closed for the Corvette Welcomefest event on Friday, September 15, 2023.

There were no objections to bring this item back to a future City Council Meeting.

6.9 Resolution No. 100-2023, A Resolution Authorizing Acceptance of Agreement from Milano & Grunloh Engineers, LLC for Red Oak Street Construction from Hendelmeyer Avenue to Blohm Avenue - City Engineer Thoele

Public Works Director Heuerman stated this resolution accepts the agreement from Milano & Grunloh Engineers, LLC. in the total amount of $42,066 for the Red Oak Street Construction from Hendelmeyer Avenue to Blohm Avenue Project. Payment for this project will be made from General Fund.

There were no objections to bring this item back to a future City Council Meeting.

6.10 Letter of Intent for Jurisdictional Transfer (State and Local Public Agency) - Public Works Director Heuerman

Public Works Director Heuerman stated this resolution authorizes the letter of intent to enter into a future agreement to accept the future jurisdiction and maintenance responsibilities of 699.01 feet Heritage Avenue and 1092.33 feet of Hampton Drive, which will include the land rights.

Any necessary items will be brought back to a future City Council Meeting. 6.11 Bid Letting - City Engineer Thoele

Public Works Director Heuerman stated bids for the Thies Avenue Extension/Airport Road Improvements Project will be accepted until August 24, 2023, at 1:30 p.m.
