Village of Dieterich Board of Trustees met June 5.

Here are the minutes provided by the board:

The Dieterich Village Board met in regular session on Monday, June 5, 2023 at 6:30 p.m. at Dieterich Village Hall located at 103 W. Section Street.

The meeting was called to order by President Brad Hardiek and the Pledge of Allegiance was recited.

The following Trustees were present: Jeff White; Fred Bray; Carrie Galbraith; Matt Flower and Pam Hartke. Trustee Bill Lane was absent. With five Trustees and President Brad Hardiek present, a quorum was declared to be present. Also at the meeting were: Village Clerk Brittny Gipson, Village Maintenance Supervisor Mike Campbell, Matt Worman, Kelsey Montoya, Sal Montoya, Mike Meyer, Ashley Meyer, Sonjia Martin, Tyler Niemerg, Lauren Niemerg, and Darin Worman.

A motion was made by Trustee P. Hartke; seconded by Trustee C. Galbraith to approve the omnibus agenda: approve minutes of the May 15, 2023 regular meeting, approve the Treasurer’s Report and approve Expenditures. Roll call was 5 yes and 0 no.

Village Engineer Lee Beckman was absent from the meeting, so no Village Engineer report was given.

Maintenance Supervisor Mike Campbell reported the three summer employees had started and they were doing great. The rental street sweeper was set to be delivered on June 19th and Liberty Park mulch would be spread in about a week. Mike reported the sidewalk on Loda Street would be repaired this week.

Mike reported he was in the process of getting quotes for tree work to be completed at Liberty Park. There are dead trees that need to be removed, stumps ground down, and trees with large limbs that need trimmed. He was estimating the cost to be between $3,000 and $6,000.

A motion was made by Trustee J. White; seconded by Trustee M. Flowers to approve AKRA Pay Request #5 for $185,270.40 for the Wright Family Center Construction. Roll call was 5 yes and 0 no.

The Board reviewed a draft building plan and parking lot layout for the proposed Rail Yard Bar & Grill and Modern Stitch Boutique that will be sharing the building located at 200 W. Center Street. Tyler and Lauren Niemerg were present to represent the owners. The owners of the building bought the adjacent 204 W. Center Street property to the west and are proposing a 20’ extension on the west side of the existing building for an outdoor seating patio area and walk-in cooler space. They are also planning to build a permanent overhang on the front of the building entrance. The property at 204 W. Center Street currently has a reverter clause on the deed that requires a commercial business be built on the property. The owners are requesting the patio addition to the west end of the existing building, that would extend onto the 204 W. Center Street property, satisfy the reverter requirement.

Matt Worman and Darin Worman were present to represent the owners of the proposed Rail Yard Bar and Grill. They gave details on seating capacity, employees needed, days they plan to operate and ideas for the patio area with fencing.

A motion was made by Trustee J. White; seconded by Trustee F. Bray that if a 20’ patio addition to the west end of the building at 200 W. Center Street was built, it would satisfy the requirements to release the reverter for the 204 W. Center Street property, once the structure was built. Roll call was 5 yes and 0 no.

A motion was made by Trustee F. Bray; seconded by Trustee P. Hartke to approve a Gold Sponsorship for $2,000 for the Village of Dieterich 4th of July Celebration. Roll call was 5 yes and 0 no.

The Board reviewed solar panel proposals for both the Village Hall and the sewer lagoon property. After discussion, it was agreed the cost was too high for solar at the sewer lagoon. The Board would like more information on the proposed solar panels on the roof of Village Hall. Everyone is aware that Village Hall needs a new roof prior to any solar installation.

Clerk Gipson reviewed the draft appropriations ordinance and reviewed upcoming projects that need to be added. She will work with the Village Attorney to prepare a final draft for review.

During the Public Comments portion of the meeting, Kelsey Montoya requested to address the Board regarding concerns she has with the proposed Rail Yard Bar & Grill. She and her family live at 203 Fayette, which is north of the proposed new business. Her concerns were about increased traffic and parking on Fayette and Pine Streets and the need to slow down traffic on those streets. She had concerns about needing stop sign improvements at the existing intersection of Pine and Fayette Streets and stopping unauthorized non-highway vehicles from coming to Dieterich. She is also worried about increased noise and the possibility of outdoor entertainment. She questioned the plans for fencing and landscaping.

Sonjia Martin was the next resident to address the Board. She lives next door to the west of the proposed new business. She has concerns about noise, being able to keep her windows open and lights shining in her bedroom windows. She doesn’t want any extra noise and wants a fence put up. She wants to see a restaurant, but not another bar in Dieterich.

Mike Meyer also requested to address the Board during the Public Comments portion of the meeting. He lives at 205 Fayette Street with his family. The proposed parking lot for the new business will be caddy corner to his property. He has concerns about Village Codes being followed for parking, loading and unloading spaces, noise, and setbacks for the proposed addition. He also has concerns about locating their trash dumpster in the alley, parking lot lighting being a nuisance and security cameras recording his family in their yard. He doesn’t agree with the proposed business having business hours until 1 a.m.

President Hardiek thanked the speakers for their comments.

During the Trustee comments portion of the meeting, Trustee F. Bray asked for the Village to do a survey of other cemeteries and ask what they charge for their burial plots.

Clerk Gipson asked the Board how they wanted to address the issue of a request to transfer a lost cemetery deed. The Board asked Clerk Gipson to consult with the Village Attorney.

Clerk Gipson reported that after almost 30 years Norma Deters would be retiring from the coordinator of the Dieterich Meals on Wheels program on June 16th. The Board agreed to purchase Norma a gift for her retirement.

At 7:51 p.m. a motion was made by Trustee J. White; seconded by Trustee C. Galbraith to adjourn the meeting. Roll call was 5 yes and 0 no.
