Village of Montgomery Board of Trustees met Jan. 23.

Here are the minutes provided by the board:

I. President Brolley called the meeting to order at 7:00 p.m. followed by the Pledge of Allegiance.

II. Roll Call

Also present: Village Administrator Jeff Zoephel, Village Attorney Laura Julien, Village Engineer Pete Wallers, Director of Public Works Mark Wolf, Chief of Police Phil Smith, Director of Community Development Sonya Abt, Director of Finance Jennifer Milewski, Communications Manager Kristina Nemetz, Engineer Chris Ott, Members of the Press and others.

III. Public Participation

A. Swearing in of Police Officers .

New Police Officers Damion Woods, Caine Culver and Kevin Lessner were sworn in by President Brolley.

B. Recognition of Atrevete ’s induction to the Illinois Made program.

President Brolley announced the induction of Atrevete into the Illinois Made Program. He congratulated Jacquie and the Atrevete team for their achievement and presented Jacquie with the award. Cort Carlsson of the AACVB was also present. A short recess was taken at 7:17p.m. so photos could be taken. The meeting was called back to order at 7:27p.m.

C. Public Comments ( Two Minute Opportunity ).

Charlene Johnson spoke regarding a possible contract for property that is for sale in Montgomery. Her clients are in Miami but will send plans to the Village soon. President Brolley said that staff will review the plans as soon as they are received.

IV. Consent Agenda

A. Minutes of the January 9, 2023 Village Board Meeting .

B. Executive Session Minutes of the January 9, 2023 Village Board Meeting. C. Account s Payable through January 23, 2023 in the Amount of $795,437.78. D. Accounts Receivables f or December 2022.

E. Refuse Report for November 2022.

F. Ordinance 1997 Granting the Expansion of a Special Use Permit for Outdoor Storage (Aucutt Truck Terminal - 1975 Aucutt Road) (Second Reading). Trustee Bauman moved to approve Items A-F of the Consent Agenda . Trustee Jungermann seconded this motion.

5 Yea. 0 No. Motion carried. Trustee Bauman, Trustee Jungermann, Trustee Marecek, Trustee Betsinger and Trustee Gier voting yea.

V. Items for Separate Action

A. Resolution 2022-0 23 Approving a Settlement with Com Ed.

Attorney Julien explained that a consultant accountant discovered funds that are owed to the Village. This agreement is to settle the matter and receive those funds.

Trustee Marecek moved to approve Resolution 2022-0 23 Approving a Settlement with ComEd. Trustee Jungermann seconded this motion.

4 Yea. 1 No. Motion carried. Trustee Marecek, Trustee Gier, Trustee Bauman and Trustee Jungermann voting yea. Trustee Betsinger voting no.

B. Resolution 2023-002 Accepting Water, Stormwater Management and Landscape Easements and Right-of-Way for Rochester Drive (Trans Lines, Inc.) for the Village of Montgomery .

Director Abt reviewed that Trans Lines was required to finish certain work which has been done and the Village is ready to accept it. This resolution will approve the plat of easement and also the dedication of Rochester Drive.

Trustee Marecek moved to approve Resolution 2023-002 Accepting Water, Stormwater Management and Landscape Easements and Right-of-Way for Rochester Drive (Trans Lines, Inc.) for t he Village of Montgomery . Trustee Bauman seconded this motion.

5 Yea. 0 No. Motion carried. Trustee Marecek, Trustee Betsinger, Trustee Gier, Trustee Bauman and Trustee Jungermann voting yea.

C. Professional Services Agreement with EEI in the amount of $ 108,442.00 for North River Street Water Main Replacement .

Director Wolf stated the Village has accepted a contract with Kane County Excavating to replace the water main on North River Street. This agreement with EEI is for construction observation.

Trustee Gier moved to approve the Professional Services Agreement with EEI in the amount of $108,442.00 for North River Street Water Main Replacement . Trustee Marecek seconded this motion.

5 Yea. 0 No. Motion carried. Trustee Gier, Trustee Bauman, Trustee Jungermann, Trustee Marecek and Trustee Betsinger voting yea.

D. Resolution 2023-003 Reaffirming the Selection of Lake Michigan as the Preferred Water Source and the DuPage Water Commission as the Prefe rred Water Supplier for the Village of Montgomery .

Engineer Wallers explained that the Village was requested to reaffirm its decision to go to Lake Michigan water and move forward with a permit from IDNR. This resolution accomplishes that.

Trustee Gier moved to approve Resolution 2023-003 Reaffirming the Selection o f Lake Michigan as the Preferred Water Source and the DuPage Water Commission as the Preferred Water Supplier for the Village of Montgomery . Trustee Jungermann seconded this motion.

5 Yea. 0 No. Motion carried. Trustee Gier, Trustee Bauman, Trustee Jungermann, Trustee Marecek and Trustee Betsinger voting yea.

VI. Items for Discussion

A. Liquor License Request for New Restaurant – 1587 Douglas Rd.

This item is being postponed at the request of the petitioner.

VII.New or Unfinished Business

Trustee Marecek announced that the Polar Plunge will be on March 5th and urged everyone to support this event that helps fund the Illinois Special Olympics.

VIII. Future Meetings

A. Planning and Zoning Commission – Thursday, February 2, 2023 at 7:00P. B. Beautification Committee – Wednesday, February 8, 2023 at 6:00P. C. Village Board Meeting - Monday, February 13, 2023 at 7:00P.
