City of Olney Board of Appeals met Aug. 1.

Here are the minutes provided by the board:

AGENDA #1 “CALL TO ORDER” The meeting of the Board of Appeals was called to order at 7:00 p.m. in the Council Chambers of the Olney City Hall, 300 S. Whittle Avenue, Olney, Illinois, with Tony Zuber presiding.

AGENDA #2 “ROLL CALL” The following Board of Appeals members were present: Bridgett Jensen, David Abell, Pat Everette, and Tony Zuber. Kurt Ginder, Scott Jones, and Samantha Brazil were absent. Also present were Code Enforcement Officer Dallas Colwell, and City Clerk Kelsie Sterchi.

AGENDA #3 “APPROVE MINUTES OF THE BOARD OF APPEALS MEETING ON JUNE 6, 2022” Mr. Abell moved to approve the minutes from June 6, 2022, seconded by Mr. Everette. Mrs. Jensen, Mr. Abell, Mr. Everette, and Mr. Zuber voted yes. There were no opposing votes. The motion carried.

AGENDA #4 “SWEARING IN” Mr. Zuber asked that anyone wishing to testify on behalf of the items being discussed to stand and be sworn in. City Clerk Sterchi asked the individuals to stand, raise their right hands, and “swear to tell the truth, the whole truth and nothing but the truth so help me God.” Lee Scherer and Andy Griffin were sworn in.

AGENDA #5 “VARIANCES: 1123 E. BUTLER STREET” Eric Brault had submitted Requests for Variation for 1123 E. Butler Street, Olney, Illinois, Property Index Number 06-35-304-063. The petitioner was requesting a variance in the two front yard setbacks to allow for a 10-foot setback on E. Butler Street and a 18-foot setback on N. Grant Street rather than the 25-foot front yard setbacks required in Title 17 (Zoning) of the City of Olney Municipal Code. The granting of the variances would allow the petitioner to build a residence. Mr. Scherer was present as an agent on behalf of Mr. Brault.

No comments for or against the request had been received by the City Clerk.

Mr. Zuber asked Mr. Colwell if the proposed setbacks would be in line with the rest of the neighborhood. Mr. Colwell believed so and noted that the widening of Butler Street had made the setbacks even more difficult to be in compliance. Mr. Colwell had no issue with the variance request.

Mr. Zuber asked the Board if the proposed variance requests would adversely affect the neighborhood. The Board did not believe so.

Mr. Zuber asked if the general public’s health, safety, or welfare would be a concern as a result of the variance requests. The Board did not believe so.

Mr. Zuber asked if the granting of the variances would allow for the best use of the property while also increasing property values and conforming to the neighborhood. The Board believed so.

Lastly, Mr. Zuber asked if there would be a gain or loss to the public at large from the granting of the variances. The Board did not believe so.

Mr. Abell asked if the petitioner would still purchase the property if the variances were not granted. Mr. Scherer indicated that the sale would not go through without the granting of the variances. The purpose of purchasing the property would be for the petitioner to build a home for his mother.

Mr. Everette moved to approve a 10-foot front yard setback on E. Butler Street and a 18- foot front yard setback on N. Grant Street for 1123 E. Butler Street, seconded by Mrs. Jensen. Mrs. Jensen, Mr. Abell, Mr. Everette, and Mr. Zuber voted yes. There were no opposing votes. The motion carried.

AGENDA #8 “PUBLIC COMMENTS/PRESENTATIONS” No one from the public wished to speak.

AGENDA #9 “ADJOURN” Mrs. Jensen moved to adjourn, seconded by Mr. Everette. Mrs. Jensen, Mr. Abell, Mr. Everette, and Mr. Zuber voted yes. There were no opposing votes. The motion carried.

The meeting of the Board of Appeals adjourned at 7:05 p.m.
