Village of Montgomery Village Board met Aug. 10.

Administrator Zoephel called the meeting to order at 7:01 p.m. He requested a motion to nominate a President pro tem to preside over the meeting as President Brolley was not in attendance. Trustee Jungermann moved to approve Trustee Lee as President pro tem.
Trustee Marecek seconded this motion. All were in favor to accept this nomination.

Also present: Administrator Jeff Zoephel, Attorney Laura Julien, Director of Public Works Mark Wolf, Director of Finance Justin VanVooren, Engineer Peter Wallers, Senior Planner Jerad Chipman, Chief of Police Phillip Smith, Clerk Penny Fitzpatrick, Members of the Press and others.
Administrator Zoephel noted the Board meeting was being held both in person and remotely via video conference due to COVID-19 circumstances. Trustees Lee and Sperling were present for the meeting via video conference.

Consent Agenda
A. Minutes of the Village Board Meeting of July 27, 2020.
B. Building Report for July 2020.
C. Accounts Payable through August 6, 2020 in the Amount of $569,350.64. D. Cancellation of the August 18, 2020 Committee of the Whole Meeting.
Trustee Marecek moved to approve Items A-D of the Consent Agenda. Trustee Jungermann seconded this motion.

Items for Separate Action
A. Recommendation of the Plan Commission on PC 2020-005 Special Use Amendment Request for an Outdoor Café Located at 1700 Douglas Road – Grandma’s Table Restaurant.
Senior Planner Chipman summarized this Plan Commission Recommendation for a Special Use for Grandma’s Table Restaurant for an Outdoor Café. He noted previous temporary outdoor dining approval had been granted to the applicant to be able to operate during the COVID-19 pandemic. He further shared the necessary improvements needed to expand their outdoor dining area would be installed pending Board approval. Trustee Lee commented that both Grandma’s Table Restaurant and Poor Boy’s Pub had shared their gratitude for being granted the ability to serve their customers in outdoor dining areas during the pandemic restrictions.
Trustee Jungermann moved to approve Recommendation of the Plan Commission on PC 2020-005 Special Use Amendment Request for an Outdoor Café Located at 1700 Douglas Road – Grandma’s Table Restaurant. Trustee Marecek seconded this motion.

B. Ordinance 1883 Granting a Special Use Amendment for an Outdoor Cafe (1700 Douglas Road – Grandma’s Table Restaurant) (First Reading).
Trustees Sperling, Jungermann and Marecek questioned and Administrator Zoephel noted this was the First Reading for Ordinance 1883. He clarified no action would be taken on this item at this time and it would be voted on at a future meeting.
C. Recommendation of the Plan Commission on PC 2020-006 Special Use Amendment Request for an Outdoor Café Located at 283 Montgomery Road – Poor Boy’s Pub.
Senior Planner Chipman summarized this Plan Commission Recommendation for a Special Use for Poor Boy’s Pub for an Outdoor Café. He noted previous temporary outdoor dining approval had been granted to the applicant to be able to operate during the COVID-19 pandemic and they had created an outdoor dining area for use in front of their business. He shared the Plan Commission had recommended approval of this request and clarified improvements for this special use would be installed pending Board approval.
Trustees Sperling and Marecek inquired and Senior Planner Chipman clarified staff had recommended approval of this request. He further shared the applicant would need to receive property owner approval to be able to install fencing around their outdoor dining area to properly control pedestrian traffic and access. Trustee Lee further questioned and Senior Planner Chipman explained that fencing surrounding this outdoor dining area would need to be installed in compliance with liquor license requirements.
Trustee Marecek moved to approve Recommendation of the Plan Commission on PC 2020-006 Special Use Amendment Request for an Outdoor Café Located at 283 Montgomery Road – Poor Boy’s Pub. Trustee Gier seconded this motion.

D. Ordinance 1884 Granting a Special Use for an Outdoor Cafe (283 Montgomery Road – Poor Boy’s Pub) (First Reading).
Trustee Marecek requested that Ordinances 1883 and 1884 Granting a Special Use for an Outdoor Café for Grandma’s Table Restaurant and Poor Boy’s Pub be placed on the Consent Agenda for the next meeting. Administrator Zoephel noted there was Board consensus in favor of this request.
E. Professional Services Agreement with Engineering Enterprises for the 2021 MFT & Infrastructure Road Program Design Engineering.
Director Wolf summarized the Professional Services Agreement with Engineering Enterprises for the Design Engineering portion of the 2021 MFT & Infrastructure Road Program. He noted another Construction Management agreement would come before the Board for approval at a later date and shared that bids would be sought early next year to secure favorable contract pricing and keep the project on schedule. Director Wolf further shared the budgeted contract amount and noted it was included in the current fiscal year budget.
Trustee Betsinger inquired and Director Wolf addressed whether he anticipated any pricing, scheduling or material availability delays with this project. He shared some street light and traffic signal electrical material delays had been experienced due to COVID-19 circumstances and noted he would look into whether any upcoming road program projects could also be affected by these issues.
Trustee Marecek moved to approve Professional Services Agreement with Engineering Enterprises for the 2021 MFT & Infrastructure Road Program Design Engineering. Trustee Betsinger seconded this motion.

F. Resolution 2020-019 Authorizing a Forgivable Loan for Grandma’s Table Restaurant.
Director VanVooren summarized a $10,000 Forgivable Loan Request for Grandma’s Table Restaurant for parking lot resurfacing and noted the Montgomery Development Fund Committee had recommended approval of this request. Trustee Lee inquired and Director VanVooren clarified that this resolution correctly addressed this forgivable loan request.
Trustee Gier moved to approve Resolution 2020-019 Authorizing a Forgivable Loan for Grandma’s Table Restaurant. Trustee Jungermann seconded this motion.

G. Resolution 2020-020 Authorizing a Forgivable Loan for Main and Webster Partners, LLC.
Director VanVooren summarized a $10,000 Forgivable Loan Request for Main and Webster Partners, LLC to replace front/rear steps, railings, exterior doors and to reroof the building at 105 N. Main Street. He shared the Montgomery Development Fund Committee had recommended approval of this request. Trustee Marecek clarified the Montgomery Development Fund Committee had specified the funds provided would specifically be used to improve the commercial portion of the roof for this property. Trustee Sperling asked and Trustee Marecek clarified the funds could not be applied to improve the residential portion of the roof.
Trustee Marecek moved to approve Resolution 2020-020 Authorizing a Forgivable Loan for Main and Webster Partners. Trustee Gier seconded this motion.

Administrator Zoephel noted there were No Items for Discussion for this meeting.
New or Unfinished Business
Trustee Jungermann requested an update on the ComEd approval status for the completion of the Shared Use Path from the Fairfield/Foxmoor Neighborhood to the Stuart Sports Complex. Senior Planner Chipman noted approval had not yet been granted but that staff was working with the ComEd Legal Department to secure a finalized letter of approval soon. Trustee Jungermann also inquired and Senior Planner Chipman discussed what the lease and legal fee expense for this item could be and noted he would report back on further details.
Trustee Sperling publicly congratulated Montgomery Police Detective Gonzalez for being promoted to Sergeant. Trustee Lee inquired when the front counter construction project for Montgomery Village Hall would be completed so the building could be reopened to the public. Director Wolf explained that glass material delays had been experienced due to COVID-19 circumstances and noted he would follow up with the contractor and report back on when this project was estimated to be completed.
