City of Olney Zoning Board of Appeals met June 4.

Here is the minutes provided by the Board:

Agenda #1 “Call To Order” The June 4, 2018, meeting of the Board of Appeals was called to order at 7:06 p.m. in the Council Chambers of the Olney City Hall, 300 S. Whittle Avenue, Olney, Illinois, with Tony Zuber presiding.

Agenda #2 “Roll Call” The following Board of Appeals members were present: Belinda Henton, Tony Zuber, David Abell, and Pat Everette. Kurt Ginder, Scott Jones, and Barb Roberts were absent. Also present were Code Enforcement Officer Mike Mitchell, and City Clerk Kelsie Sterchi.

Agenda #3 “Approve Minutes Of The Board Of Appeals Meeting On April 2, 2018” Mrs. Henton moved to approve the minutes of the Board of Appeals meeting on April 2, 2018, seconded by Mr. Everette. Mrs. Henton, Mr. Zuber, Mr. Abell, and Mr. Everette voted yes. There were no opposing votes. The motion carried.

Agenda #4 “Swearing In” Mr. Zuber asked that anyone wishing to testify on behalf of the items being discussed to stand and be sworn in. City Clerk Sterchi asked the individuals to stand, raise their right hand, and “swear to tell the truth, the whole truth and nothing but the truth so help me God.” Scott Spillman, Shawn Taylor, and several residents of the Northside Subdivision were sworn in.

Agenda #5 “Variance: 1201 N. Morgan Street” Scott Spillman submitted a Request for Variance for 1201 N. Morgan Street. Mr. Spillman was requesting a variance in the front yard setback to allow a 4-foot setback rather than the 25-foot front yard setback required in Title 17 (Zoning) of the City of Olney Municipal Code. If the variance is approved, it would allow the petitioner to place a carport on the property.

The City Clerk had received an e-mail of objection if the carport were to be placed on the East side of the house, or parallel to Bower Street.

Mrs. Henton asked for clarification on where Mr. Spillman wished to place the proposed carport. Mr. Spillman replied it would be in front of his garage on the Bower Street side.

Mr. Everette asked why Mr. Spillman could not use his garage instead of a carport to house his vehicle. Mr. Spillman replied that he had two vehicles, and the current garage was only a one car garage.

Mr. Everette moved to approve the variance request for an 4-foot setback rather than the 25-foot front yard setback at 1201 N. Morgan Street for the purpose of placing a carport on the property, seconded by Mrs. Henton. Mrs. Henton Mr. Zuber, Mr. Abell, and Mr. Everette voted yes. There were no opposing votes. The motion carried.

Agenda #6 “Variance: 1304 Lakepoint Circle" Shawn W. Taylor submitted a Request for Variance for 1304 Lakepoint Circle. Mr. Taylor was requesting a variance in the requirements in Title 17 (Zoning) of the City of Olney Municipal Code regarding a storage or parking garage as an accessory building. If the variance is approved, it will allow the petitioner to build a garage on the property without a main structure.

Mrs. Henton asked if Mr. Taylor would be building a garage on the property if the variance was granted. Mr. Taylor confirmed.

Northside Subdivision had Protective Covenants in place. Even if the Board of Appeals approved the request for variance, a subdivision committee would need to vote in favor of the exception. Mrs. Henton noted that the Protective Covenants specifically stated that no garages without homes would be allowed. Mrs. Henton asked the audience if the neighborhood would be in favor of the variance request. Several members of the audience shook their heads to indicate they would not be in favor.

In addition, the City Clerk had received letters of objection signed by 11 individuals.

Mr. Zuber recalled that such variance requests had come before the Board of Appeals in the past where Protective Covenants were in place. The Board of Appeals had denied or not taken action on the requests.

Mrs. Henton moved to deny the variance request for 1304 Lakepoint Circle regarding a storage or parking garage on the property without a main structure, seconded by Mr. Everette. Mrs. Henton, Mr. Zuber, Mr. Abell, and Mr. Everette voted yes. There were no opposing votes. The motion carried.

Agenda #7 “Public Comments/Presentations” No one from the public wished to speak.

Agenda #8 “Adjourn” Mr. Everette moved to adjourn, seconded by Mr. Abell. Mrs. Henton, Mr. Zuber, Mr. Abell, and Mr. Everette voted yes. There were no opposing votes. The motion carried.

The meeting of the Board of Appeals adjourned at 7:12 p.m.
