Mattoon City Council approves a $7,000 grant

The Mattoon City Council met Sept. 20 to approve a $7,000 grant by the Tourism Advisory Committee.

Here are the meeting's minutes, as provided by the council:

The Marshall City Council, which includes six members and the mayor, meets at 7:30 p.m. on the second and fourth Monday of each month at City Hall, 201 S. Michigan Ave.

The City Council of the City of Mattoon held a regular meeting in the City Hall Council Chambers on September 20, 2016.

Mayor Gover presided and called the meeting to order at 6:30 p.m.

Mayor Gover led the Pledge of Allegiance.

The following members of the Council answered roll call physically present: YEA Commissioner Dave Cox, YEA Commissioner Sandra Graven, YEA Commissioner Rick Hall, YEA Commissioner Preston Owen, and YEA Mayor Tim Gover.

Also physically present were City personnel: City Administrator Kyle Gill, City Attorney Janett Winter-Black, Finance Director/Treasurer Beth Wright, Public Works Director Dean Barber, Fire Chief Tony Nichols, Police Chief Jeff Branson, Arts & Tourism Director Angelia Burgett, and City Clerk Susan O’Brien.

CONSENT AGENDA

Mayor Gover seconded by Commissioner Hall moved to approve the consent agenda consisting of minutes of the regular meeting September 6, 2016, and bills and payroll for the first half of September, 2016.

PRESENTATIONS, PETITIONS AND COMMUNICATIONS

Mayor Gover opened the floor for questions with no response from the Public.

Commissioner Hall presented a plaque in appreciation of the years of volunteer service to Mr. Kenneth Wooddell and provided accolades to Mr. Wooddell. Mr. Wooddell expressed appreciation in receiving the acknowledgement and described Mattoon’s community volunteerism with pride. Mayor Gover thanked Mr. Wooddell for his service within the City of Mattoon since 1949 and his support of the City of Mattoon.

NEW BUSINESS

Commissioner Hall seconded by Commissioner Owen moved to approve Council Decision Request 2016-1717, ratifying the re-appointments of Scott Gradle, Mike Kallis, and Julia Colombo; and appointments of Christina Browning and Amanda Standerfer to the Mattoon Arts Council for terms expiring September 30, 2018.

Commissioner Graven seconded by Commissioner Cox moved to approve Council Decision Request 2016-1718, approving the expenditure of $41,775.00 in construction changes for the Marshall Avenue Project. 14-00266-00-PV

Commissioner Graven seconded by Commissioner Cox moved to adopt Resolution No. 2016-2974, authorizing the MFT expenditure of $42,000 for pavement removal and replacement on Marshall Avenue from 6th to 9th Street, including storm sewer, curb and gutter, sidewalk repairs, and driveways – Marshall Avenue Project. 14-00266-00-PV

Mayor Gover opened the floor for questions/comments. Commissioner Cox inquired as to the advancement of the project, sidewalk challenge, and community sidewalk. Director Barber described the progress, additional sidewalks, and majority of sidewalks would be community sidewalks. Mayor Gover inquired as to the completion of 8th and 9th Street with Director Barber providing an update on the concrete pouring. Mayor Gover opened the floor for further questions with no response.

Mayor Gover seconded by Commissioner Hall moved to approve Council Decision Request 2016-1719, authorizing the purchase of a 2016 Ford Taurus SE Detective Package in the amount of $17,621 from Landmark Ford for the Mattoon Police Department.

Mayor Gover seconded by Commissioner Hall moved to approve Council Decision Request 2016-1720, authorizing the purchase of a 2017 Ford Utility Police Interceptor AWD in the amount of $31,111 from Landmark Ford for the Mattoon Police Department.

Commissioner Hall seconded by Commissioner Cox moved to approve Council Decision Request 2016-1721, approving a $7,000 grant by the Tourism Advisory Committee from hotel/motel tax funds to the Mattoon YMCA for hosting three events: The Last Tri; Ghouls in the Pool; and Girls Run 5K to be held October 2, October 29 and November 12, 2016 respectively; and authorizing the mayor to sign the agreement.

USALCO for Alum @ $0.1809/pound; Brenntag Mid-South & Hawkins for Ammonium Sulfate@ $0.2950/pound; Polydyne for Cationic Polymer @ $0.3800/pound; JCI Jones for Chlorine @ $0.1890/pound; Hawkins for Fluoride @ $0.3250/pound; Shannon Chemical for Permanganate @ $0.8240/pound; Hawkins for Phosphate Blend @ $0.4391/pound; and, Thatcher for Powdered Activated Carbon @ $0.5546/pound.

Commissioner Cox seconded by Commissioner Graven moved to adopt Ordinance No. 2016-5390, amending Chapter 72 of the municipal code regarding parking regulations on City Right-of-Way and on the Boulevard.

CITY OF MATTOON, ILLINOIS

ORDINANCE NO. 2016-5390

AN ORDINANCE AMENDING CHAPTER 72 OF THE MUNICIPAL CODE REGARDING PARKING REGULATIONS ON CITY RIGHT-OF-WAY AND ON THE BOULEVARD

WHEREAS, the corporate authority of the City of Mattoon has defined and set general provisions for parking within the corporate boundary of the municipality; and

WHEREAS, the corporate authorities of the City have determined that it would be in the best interest of the City and its residents to make changes in Chapter 72 of the municipal code.

NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Mattoon as follows:

Section 1. Recitals. The facts and statements contained in the preamble to this Ordinance are found to be true and correct and are hereby adopted as part of this Ordinance.

Section 2. Code Amendment. Section §72.08 of Chapter 72 of the Code of Ordinances of the City of Mattoon is hereby repealed.

Section 3. Code Amendment. Chapter 72 of the Code of Ordinances of the City of Mattoon is hereby amended by the adoption of Section 72.30 as follows:

§ 72.30 DEVELOPED PARKING ON CITY RIGHT-OF-WAY.

(A) Definitions:

(1) Right-of-way the area reserved for public use, located between privately owned parcels.

(2) Boulevard - the area existing between the edge of the traveled/parking surface of any street without curbs and the property line parallel to such street.

(3) Improved Boulevard - the area existing between the curb line of any street improved with curbs and the property line parallel to such street.

(4) Developed Boulevard - the area existing between the traveled/parking surface of any street and /the curb line of any street and the property line parallel to such street which has been developed for parking purposes.

(B) Boulevard Parking Prohibited:

The parking of motor vehicles on any Improved Boulevard is hereby declared to be illegal and a violation of this Ordinance. The creation of a Developed Boulevard contrary to the terms of this Section is hereby declared to be illegal and is a violation of this Ordinance.

(C) Boulevard Permit Procedure:

Any owner, occupier or developer of real estate located within any Commercial or Industrial Zoned District may be allowed to use the right-of-way contiguous to said property as developed parking for motor vehicles provided that:

(1) An application for developed right-of-way parking shall be submitted to the Building Inspector at City Hall, 208 North 19th Street, Mattoon, Illinois.

(2) The application shall indicate the following information: name and address of the property owner; name and address of the occupier; the reason that right-of-way parking is requested; whether or not the boulevard parking requested is necessary to meet the minimum regulations for off-street parking found in Chapter 159 Zoning; the existing use of the real estate located immediately adjacent to the proposed right-of-way parking area;

and, the proposed use of the adjacent real estate for which right-of-way parking is requested.

(3) A drawing showing the location of the area for which the permit is sought and showing the length and width of the area to be developed as boulevard parking shall be provided with the application.

(4) Developed Boulevard parking is permitted only if the following conditions are met:

(a) No more than 60% of the City right-of-way can be used as vehicle parking.

(b) For every 50 feet or less of City right-of-way to be utilized for vehicle parking, one City-approved tree must be planted at the expense of the property owner.

(c) The parking can be developed and used without creating unsafe conditions for pedestrians or motor vehicle traffic.

(d) The parking can be developed and used without creating undue access problems for any municipal or public utilities.

(5) A permit fee per Chapter 35 §35.01(E)(1) shall be paid to the City before any application will be considered.

(6) Boulevard parking shall not be allowed on any Boulevard located adjacent to any Illinois State Highway or Federal Highway unless a permit for such parking is first granted by the Illinois Department of Transportation and submitted with the application.

Section 4. Severability. If any provision of this Ordinance, or the application of any provision of this Ordinance, is held unconstitutional or otherwise invalid, such occurrence shall not affect other provisions of this Ordinance, or their application, that can be given effect without the unconstitutional or invalid provision or its application. Each unconstitutional or invalid provision, or application of such provision, is severable.

Section 5. This ordinance shall be deemed published as of the day of its adoption and approval by the City Council.

Section 6. This ordinance shall be effective upon its publication and approval as provided by law. The City Clerk is directed to publish this ordinance in pamphlet form.

Upon motion by Commissioner Cox, seconded by Commissioner Graven, adopted this 20th day of September, 2016, by a roll call vote, as follows:

Administrator Gill explained the cleaning up of the ordinance and definitions. Commissioner Hall noted parking on a drive way across the sidewalk was also prohibited, but was located in a different section of the codification. Mayor Gover opened the floor for questions with no response.

DEPARTMENT REPORTS:

CITY ADMINISTRATOR/COMMUNITY DEVELOPMENT noted researching of parking ordinance, compilation of statistics for ICSC next month; otherwise, business as usual. Mayor Gover announced the attendance of Administrator Gill, Commissioner Owen, and himself at the IML this week. Mayor Gover opened the floor for questions with no response.

CITY ATTORNEY had nothing to report. Mayor Gover opened the floor for questions with no response.

CITY CLERK announced the consolidated election and early voting to commence on September 29th through election day, November 8th, and petitions available for the consolidated

election to be held on April 4, 2017. Mayor Gover opened the floor for questions with no response.

FINANCE distributed and reviewed the August Financial Report; reported that the third installment of property taxes should be received at the end of this month with the final installment in November; and preparation of the unclaimed property report. Mayor Gover opened the floor for questions with no response.

PUBLIC WORKS updated Council on Public Works projects: Marshall Avenue, Public Works Building, oil & chip contract, sewer pipe failure at 27th /Marion, and water main break at 27th/Charleston. Mayor Gover opened the floor for questions with no response.

FIRE noted Fire Department activities of hydrant painting, fire alarm assistance, fire extinguisher demos, aiding during Special Olympics event, and providing ambulance standby during the high school football game. Mayor Gover opened the floor for questions. Commissioner Cox noted Superintendent Dave Basham’s appreciation of the Fire Department’s hydrant painting.

POLICE had nothing to report. Mayor Gover opened the floor for questions with no response.

ARTS AND TOURISM reported on the variety of events taking place in Mattoon and surrounding community. Mayor Gover opened the floor for questions with no response.

COMMENTS BY THE COUNCIL

Commissioners Cox, Graven, Hall, and Owen had no further comments.

Mayor Gover seconded by Commissioner Hall moved to recess to closed session at 6:58 p.m. pursuant to the Illinois Open Meetings Act for the purpose of the discussion of litigation under Section 2(c)(11) that is affecting the City of Mattoon (5 ILCS 120(2)(c)(11)).
