2.2 Ordinance No. 065-2025, An Ordinance Authorizing the Sale of Personal Property (2006 John Deere Backhoe) - City Administrator Miller
The City Administrator is hereby authorized to see the property in "as is" condition, to the Effingham Water Authority, for the sum of thirty-five thousand dollars (35,000.00).
2.3 Resolution No. 119-2025, A Resolution Granting Permission to Allow a Portion of City Streets to be Temporarily Closed for Ham City Fall Fest - Tourism Director Thoele
2.4 Resolution No. 125-2025, A Resolution Granting Permission to Effingham High School to have an Effingham High School Homecoming Parade on Sunday, September 21, 2025 - Tourism Director Thoele
This resolution grants permission to EHS to have the Homecoming Parade on Sunday, September 21, 2025.
2.5 Sanitary Sewer Improvements - Change Order 2 - City Engineer Thoele
Change Order 2 in the total amount of $115,565.90 is recommended for storm and sanitary sewer lining work completed with the Sanitary Sewer Improvement Project.
2.6 2025 Pavement Patching - Change Order 1- City Engineer Thoele
Change order 1 in the amount of $113,852.50 is recommended for the increased quantities to repair construction areas along Shenandoah Ave.

Police Chief Davis presented Officer Ryan Holesapple with the Chief’s Commendation Award.
4. ORDINANCES/RESOLUTIONS - ACTION ITEMS
4.1 Ordinance No. 055-2025, An Ordinance Implementing Non-Home Rule Municipal Retailers' Occupation Tax and a Non-Home Rule Municipal Service Occupation Tax for the City of Effingham- City Administrator Miller
This ordinance allows a local 1% sales tax for a non-home rule community such as Effingham.
Dallas Bear submitted a speaker’s card and presented to the Council regarding the 1% Sales Tax.

4.2 Ordinance No. 064-2025, An Ordinance Implementing a Municipal Grocery Retailers' Occupation Tax and a Municipal Grocery Service Occupation Tax for the City of Effingham, Illinois - City Administrator Miller
This Ordinance allows for a local 1% Grocery Tax that would replace the states 1% Grocery Tax to be repealed effective January 1, 2026.

4.3 Ordinance No. 063-2025, An Ordinance Repealing The City of Effingham Amusement Tax - City Administrator Miller
The City Council, deems it to be in the best interest of the citizens of the City of Effingham that the City of Effingham Ordinance No. 63-2017, be repealed and to cease the imposition and enforcement of an amusement tax within the City of Effingham.

This ordinance amends the FY 2026 appointment ordinance to authorize the Mayor to appoint Christopher Ervin as Building Official.

6. DISCUSSION
6.1 Ordinance No. 066-2025, An Ordinance Amending Ordinance No. 17-2010, As Previously Amended by Ordinance Nos. 14-2012, 18-2020, and 11-2024 - Economic Development Director Hull
This Ordinance will terminate the Agracel installment contract.
There were no objections to bringing this item back to a future City Council Meeting.
6.2 Ordinance No. 067-2025, An Ordinance Granting a Tower Use Permit for a Wireless Communications Facility in Overlay District #2 - PI Tower Development, LLC and RSA 6 and 7 Limited Partnership D/B/A Verizon Wireless - Site Address: 400 JCAN Drive – Facility Address 402 JCAN Drive - City Planner Koester
The Plan Commission after three Public Hearings recommends the City Council grant the Tower Use Permit.
There were no objections to bringing this item back to a future City Council Meeting.
6.3 Resolution No. 131-2025, A Resolution Authorizing Execution of Agreement for Professional Services with Crawford, Murphy and Tilley, Inc. - Local Limits and PFAS Reduction Plan - Director of Public Works Heuerman
This resolution authorizes execution of an agreement in the amount of $112,700 with Crawford, Murphy & Tilley, Inc. for the Local Limits and PFAS Reduction Plan.
There were no objections to bringing this item back to a future City Council Meeting.
6.4 A Resolution Authorizing the Execution of a Service Agreement to the Lowest Responsible Bidder for the Supply of Electricity for Residential and Small Commercial Retail Customers Who Do Not Opt Out of Such a Program - City Attorney Willenborg
This resolution gives the City Administrator or designee permission to sign a Municipal Electrical Aggregate to the responsible bidder.
