City of Olney Board of Appeals met May 5.

AGENDA #1 “CALL TO ORDER” The May 5, 2025, meeting of the Board of Appeals was called to order at 7:00 p.m. in the Council Chambers of the Olney City Hall, 300 S. Whittle Avenue, Olney, Illinois, by David Abell.
AGENDA #2 “ROLL CALL” The following Board of Appeals members were present: Kurt Ginder, Bridgett Jensen, Brad Williams, Pat Everette, and David Abell. Scott Jones and Samantha Brazil were absent. Also present were City Clerk Kelsie Sterchi, and Code Enforcement Officer Dallas Colwell.
AGENDA #3 “APPROVE MINUTES OF THE BOARD OF APPEALS MEETING ON APRIL 7, 2025” Mr. Everette moved to approve the minutes from April 7, 2025, seconded by Mr. Williams. Mr. Ginder, Mrs. Jensen, Mr. Williams, Mr. Everette, and Mr. Abell voted yes. There were no opposing votes. The motion carried.
AGENDA #4 “SWEARING IN” Mr. Abell asked that anyone wishing to testify on behalf of the items being discussed to stand and be sworn in. City Clerk Sterchi asked the individual to stand, raise his right hand, and “swear to tell the truth, the whole truth and nothing but the truth so help me God.” Bradley Doll was sworn in.
AGENDA #5 “PUBLIC HEARING: VARIANCE REQUEST FOR 304 N. SILVER STREET” Bradley M. Doll had submitted a Request for Variation for 304 N. Silver Street, Olney, Illinois, Property Index Number 06-34-417-110. The petitioner requested a variance in the distance an accessory building can be from a main building to allow for a 7-foot distance rather than the 10-foot distance required in Title 17 (Zoning) of the City of Olney Municipal Code. The petitioner also requested a variance to allow for a 0-foot rear yard setback rather than the 25-foot rear yard setback and a 0-foot side yard setback rather than the 6-foot side yard setback as required in Title 17. The granting of the variance would allow the petitioner to build a one-car garage.
The City Clerk had not received any comments for or against the request.
Mr. Doll clarified that the setback variance requests were for an accessory building only and not a new main structure.
Mr. Colwell added that the setbacks for accessory buildings such as garages was due to the fact that they were typically used for storage of flammable materials like gasoline. The location of this garage would be very close to the property at 506 E. Butler Street.
Mr. Everette asked if the garage would be used for storage. Mr. Doll indicated that the main purpose was to shelter a vehicle.
Mr. Abell asked if this property was a rental property for Mr. Doll. Mr. Doll indicated so but noted that his children were renting the property.
AGENDA #6 “VARIANCE: 304 N. SILVER STREET” Mr. Ginder moved to approve a variance that would allow for a 7-foot distance between an accessory building and a main structure, and to approve variances to allow for a 0-foot rear yard setback and 0-foot side yard setback, seconded by Mrs. Jensen. Mr. Ginder, Mrs. Jensen, Mr. Williams, Mr. Everette, and Mr. Abell voted yes. There were no opposing votes. The motion carried.
AGENDA #7 “PUBLIC COMMENTS/PRESENTATIONS” There were no comments.
AGENDA #8 “ADJOURN” Mrs. Jensen moved to adjourn, seconded by Mr. Everette. Mr. Ginder, Mrs. Jensen, Mr. Williams, Mr. Everette, and Mr. Abell voted yes. The motion carried.
The meeting of the Board of Appeals adjourned at 7:05 p.m.
