Arbitrator orders reinstatement of deputy amid federal lawsuit against sheriff

McDonough County Sheriff Nicholas Petitgout has been directed to reinstate Deputy Evan Schmalshof with full back pay and benefits. This decision follows a grievance filed by Schmalshof, which was resolved through arbitration last week. The arbitrator found that Schmalshof neither lied nor violated policy as previously claimed.

The arbitrator's ruling stated, "After carefully considering the record in its entirety, including all of the evidence and arguments presented by the parties, it is held that the Employer violated Section 7 of the CBA and did not have just cause to terminate Deputy Evan Schmalshof."

This development may impact Petitgout's position in an ongoing federal case brought against him by Schmalshof. According to the Illinois Law Enforcement Training Standards Board, Schmalshof was terminated on January 26, 2024. However, this action appears premature since a grievance had been filed but not yet heard.

Sheriff Petitgout has previously made headlines for controversial actions such as banning Police Chief Evan Schmalshof from entering the jail. The situation at McDonough County Sheriff's office seems to be escalating with more issues coming to light.
