City Administrator Miller opened the FY25 Budget Public Hearing at 5:00 PM. No questions or comments were provided by the public or City Council. City Administrator Miller closed the Public Hearing at 5:06 PM.

4.1 City of Effingham Service Award - Public Work Director Heuerman

Public Works Director Heuerman recognized Joe Williamson for his 35 years of service at the Wastewater Treatment Plant.

5. ORDINANCES/RESOLUTIONS - ACTION ITEMS

5.1 Ordinance No. 014-2024, Fiscal Year 2025 Appointment Ordinance - City Administrator Miller

Motion to pass by Commissioner Moeller, second by Commissioner Micenheimer

Final Resolution: Motion Carried. 4-0

5.2 Ordinance No. 019-2024, An Ordinance in Regard to Amending the Zoning Ordinance of the City of Effingham - W Squared Properties, LLC R-2 Single-Family Residence District to R-3B Two and Three Family Dwelling District - 909 W. St. Anthony Avenue - City Planner Koester

City Planner Koester stated at a Public Hearing on March 12, 2024, seven of the nine Plan Commission members present voted five to two to recommend the City Council deny the Petition to rezone the Subject Property located at 909 W. St. Anthony Avenue. This was discussed at the March 19, 2024, City Council Meeting. The Petitioner requested the City Council refer the matter back to the Plan Commission for further hearing.

Motion to pass by Commissioner Moeller, second by Commissioner Micenheimer

Final Resolution: Motion Carried. 4-0

5.3 Ordinance No. 028-2024, An Ordinance Declaring Certain Real Property and Improvements thereon as being Dangerous and Unsafe (304 N. First Street) - City Administrator Miller

City Attorney Willenborg stated this ordinance declares the residential property located at 304 N. First St. as dangerous and unsafe.

Motion to pass by Commissioner Micenheimer, second by Commissioner Gillenwater

Final Resolution: Motion Carried. 4-0

7. DISCUSSION

7.1 Ordinance No. 022-2024, An Ordinance Amending Ordinance No. 4-2011 Pollution Discharge Control Ordinance and Ordinance No. 026-2020 Sewer Rates - Public Work Director Heuerman

Public Works Director Heuerman stated this ordinance amends the fee for discharging wastewater into a public wastewater treatment system and recommends the ordinance be revised.

There were no objections to bring this item back to a future City Council Meeting.

7.2 TIF Rehabilitation Project - Economic Development Director Hull

Economic Development Director Hull stated Integrity Electric and Plumbing is requesting funds for a TIF Rehabilitation Project.

There were no objections to bring this item back to a future City Council Meeting.

7.3 Eastland Apartments Replat and TIF Boundary Amendment - Economic Development Director Hull and City Planner Koester

Economic Development Director and City Planner Koester stated this is regarding the replat of Eastland Apartments for TIF/Enterprise Zone considerations.

There were no objections to bring this item back to a future City Council Meeting.

7.4 Resolution No. 025-2024, Resolution Authorizing Memorandum of Understanding Between City of Effingham and Effingham Unit #40 Board of Education for School Resource Officer - Police Chief McFarland

Police Chief McFarland stated this resolution authorizes a memorandum of understanding between the City of Effingham and Effingham Unit #40 Board of Education for a School Resource Officer for 2024/2025, 2025/2026 and 2026/2027 school years.

There were no objections to bring this item back to a future City Council Meeting. 7.5 Bid Lettings - City Engineer Thoele

Public Works Director Heuerman announced the following bid lettings:

April 9, 2024:

• 2024 Crack and Joint Sealing Program

• Jefferson Avenue Drainage

Commissioner Moeller noted the statue in memory of the St. Anthony Hospital fire arrived.

9.2 Reports from Staff - City Administrator Miller; Deputy City Administrator Presley; Public Works Director Heuerman; Economic Development Director Hull; Fire Chief Yochum; Police Chief McFarland; City Engineer Thoele; Tourism Director Thoele; City Treasurer Polk; City Clerk Nosbisch

Fire Chief Yochum provided safety reminders regarding the upcoming solar eclipse.

Police Chief McFarland announced Autism Awareness stickers for vehicles with passengers with autism are available at the Police Department.

Tourism Director Thoele announced various events for the solar eclipse on April 8, 2024. 9.3 Public Participation
