3.1 Introduction of New Police Officer - Police Chief McFarland

Police Chief McFarland introduced newly hired Police Officer Dustin St. John. 3.2 Lifesaving Award and Special Act Award - Police Chief McFarland

Police Chief McFarland presented Officer Brittany Lowry with a Lifesaving Award and Special Act Award.

3.3 Housing and Economic Recovery Plan - Economic Development Director Hull

Zach Lowe and Kyle Terry with Development Planning Partners and The 1861 Group presented the Housing Economic Recovery Plan created though the RISE Grant.

4. ORDINANCES/RESOLUTIONS - ACTION ITEMS

4.1 Ordinance No. 098-2023, An Ordinance Amending the Zoning Ordinance of the City of Effingham and Granting Special Use Permits - Sarah Bush Lincoln Health Center - Rezone from R-2 Single-Family Residence District to R-3D Multiple-Dwelling District - Special Use (17) “Offices and clinics operated by physicians, dentists or other members of the healing arts in the R-3D District” - Special Use (18) “Pharmacy in the R-3D District” - Between N. Maple Street and N. Penguin Street - City Planner Koester

City Planner Koester stated The Plan Commission, by a 5 to 3 vote, recommends the City Council approve the Petition to Rezone and the Petition for Special Use Permits with the Special Use Permits subject to the following conditions:

1. The Subject Property can only be developed with and used for offices and clinics operated by physicians, dentists or other members of the healing arts and/or a pharmacy and is prohibited from being developed with any residential use; and,

2. Petitioner shall construct such buffering as required by the City Engineer. Tim Kastl submitted a Speaker’s Card presented on behalf of Sara Busch Lincoln. Ryan Witges submitted a Speaker’s Card and presented on behalf of Agracel. Both speakers spoke in favor of rezoning.

Motion to pass by Commissioner Stephens second by Commissioner Gillenwater

4.2 Ordinance No. 099-2023, An Ordinance Amending Appendix B of the City of Effingham, Illinois Municipal Code (Zoning Ordinance No. 44-89) - Article 1. Definitions, Article 3. Compliance with the Regulations, Article 4. NU Nonurban District, Article 6. R-2 Single Family Residence District, Article 24. Regulation of Signs, Article 26. Special Use Regulations, Article 27. Site Plan Requirements - Modular Dwelling & Manufactured Home - City Planner Koester

City Planner Koester stated The City's current zoning language contains antiquated definitions and terminology concerning modular dwellings and manufactured homes. The proposed text amendment updates the definitions and terminology clarifying the difference between a "modular dwelling" and a "manufactured home" and updates the noted Articles of the Zoning Ordinance with the updated terminology. The text amendment would also now allow modular dwellings in the NU Nonurban District and would also require accessory buildings in a manufactured home park conform to Article 26-1.

The Plan Commission, by an 8-0 vote, recommends the City Council affirm and enact the text amendment as presented.

4.3 Resolution No. 151-2023, A Resolution Accepting Bid and Awarding Contract for the Henrietta Street Water Main Relocation Project - City Engineer Thoele

City Engineer Thoele stated this action awards a contract to McCarthy Improvements in the amount of $761,565 for the Henrietta Street Water Main Relocation Project. This is to be reimbursed 50% by IDOT.

4.4 Resolution No. 152-2023, A Resolution Accepting Bid and Awarding Contract for the Fayette Avenue Sanitary Sewer Main Replacement Project - City Engineer Thoele

City Engineer Thoele stated this action awards a contract to B&T Drainage in the amount of $941,339 for the Fayette Avenue Sanitary Sewer Main Replacement Project. This is to be reimbursed 100% by IDOT.

4.5 Resolution No. 153-2023, A Resolution Accepting Proposal for 2023 Street Maintenance Aggregate Material Stockpiling - City Engineer Thoele

City Engineer Thoele stated this action awards two contracts totaling $55,555 for aggregate to be used by Public Works Operations. One contract is awarded to Heuerman Brothers in the amount of $11,595 and another contract is awarded to 3 Sisters Logistics in the amount of $43,960.

4.6 2023 City Hall Fire Protection - Change Order 2 - Public Works Director Heuerman

Public Works Director Heuerman stated Change Order 2 in the total amount of $20,739.47 is recommended for domestic service line and backflow preventor work.

6. DISCUSSION

6.1 Ordinance No. 097-2023, An Ordinance Amending Ordinance No. 13-2012, An Ordinance Amending Chapter 4 of the Municipal Code of the City of Effingham, Illinois (Liquor Code) - The Local - Mayor Schutzbach

6.1 and 6.2 were discussed together.

The City Liquor Control Commission has received an application for The Local Sports Bar & Grill, Inc. for a Class R-1 Liquor License. This application was withdrawn previously due to the applicant's failure to open operations within the required timeframe. The business owners are desirous of opening as soon as possible in January 2024. This ordinance increases the number of Class R-1 Liquor Licenses by one subject to City Council adopting a resolution issuing The Local Sports Bar & Grill, Inc. a liquor license.

This resolution issues a Class R-1 Liquor License to The Local Bar & Grill, Inc. d/b/a The Local, 1313 N. Keller Drive, Effingham. This resolution is subject to passing an ordinance increasing the number of Class R-1 Liquor Licenses by one specifically for this liquor license applicant.

There were no objections to bring these items back to a future City Council Meeting.

6.2 Resolution No. 150-2023, A Resolution Authorizing the Issuance of Liquor License to The Local Sports Bar & Grill, Inc. d/b/a The Local - Mayor Schutzbach

6.3 Resolution No. 147-2023, A Resolution Authorizing the Execution of a Letter Agreement (Brycer, LLC- "The Compliance Engine" web-based services) - City Administrator Miller

Assistant Fire Chief Kulesza and City Administrator Miller stated Brycer is software for inspections. This resolution allows the City to expend fire protection funds for the purpose of a web-based service with Brycer, LLC to manage inspections and code compliance.

This item will be brought back to a future City Council Meeting for discussion and approval.

6.4 Resolution No. 148-2023, A Resolution Authorizing Execution of Local Public Agency Engineering Services Agreement for Motor Fuel Tax Funds - Phase II Design Engineering - Ford Avenue Extension & Box Culvert - City Engineer Thoele

City Engineer Thoele stated this resolution authorizes execution for a Local Public Agency Engineering Services Agreement for Motor Fuel Tax Funds with Farnsworth Group, Inc. in the total amount of $89,835, for design of the next Ford Avenue Extension and Box Culvert Project.

There were no objections to bring this item back to a future City Council Meeting.

6.5 Resolution No. 149-2023, A Resolution Authorizing Renewal of Contract with Dusty's Outdoor Media for Billboards for the 2024-2025 Calendar Years - Tourism Director Thoele

Tourism Director Thoele stated this resolution authorizes renewal of contract with Dusty's Outdoor Media for our Vandalia, IL and Kankakee, IL billboards.

6.6 Resolution No. 155-2023, A Resolution Authorizing Execution of Proposal for Engineering Services from Milano and Grunloh Engineers, LLC. Sanitary Sewer Improvements on Mt. Vernon Avenue and Jaycee Avenue - City Engineer Thoele

City Engineer Thoele stated this agreement with Milano and Grunloh Engineers, LLC provides preliminary and construction engineering services in the amount of $60,000. The project on Mt. Vernon and Jaycee Avenues is needed to provide public sewer access adjacent to lots on Jaycee between 4th Street and Park Street.

There were no objections to bring this item back to a future City Council Meeting.

6.7 Resolution No. 156-2024, A Resolution Authorizing Execution of Local Public Agency Engineering Services Agreement for General Funds- Evergreen Avenue Stage 2- Preliminary Engineering- City Engineer Thoele

City Engineer Thoele stated The City of Effingham is planning to reconstruct Evergreen Avenue from Oceola Street to Willenborg Street. This resolution authorizes execution of an Agreement with Farnsworth Group in the total amount of $175,997 for the Evergreen Avenue project. Payment for this project will be funded by General Funds.

There were no objections to bring this item back to a future City Council Meeting.

6.8 Resolution No. 157-2023, A Resolution Authorizing a Contract with Dusty's Outdoor Media for a Billboard for a Part of the 2024 Calendar Year - Tourism Director Thoele

Tourism Director Thoele stated This resolution authorizes a contract with Dusty's Outdoor Media for a billboard in Tolono, IL to promote Effingham as an eclipse destination.

There were no objections to bring this item back to a future City Council Meeting. 7. Quarterly Reports

7.1 2023 Capital Improvements Infrastructure Projects - Annual Report - City Engineer Thoele

City Engineer Thoele presented a summary of the City of Effingham's 2023 Capital Improvement Infrastructure Projects.
