3. PRESENTATIONS

3.1 Employee of the Quarter - City Administrator Miller

City Administrator Miller presented City Clerk Nosbisch as the Employee of the Quarter. 3.2 Certificate of Recognition - Police Chief McFarland

Police Chief McFarland presented an award to Ashlyn Davis in recognition of outstanding representation of the Effingham Police Department while attending FBINAA Youth Leadership Program.

4. ORDINANCES/RESOLUTIONS - ACTION ITEMS

4.1 Ordinance No. 054-2023, An Ordinance Amending the Zoning Ordinance of the City of Effingham - D & A Property Development, LLC - Rezone from R-2 Single-Family Residence District to R-3D Multiple Dwelling District 412 W. Temple Avenue - City Planner Koester

City Planner Koester stated the petition to rezone 412 W. Temple Avenue from R-2 to R-3D was unanimously recommended for approval by the Plan Commission with all members present.

Motion to pass by Commissioner Stephens, second by Commissioner Gillenwater

Final Resolution: Motion Carried. 5-0

4.2 Ordinance No. 056-2023, An Ordinance Amending the Zoning Ordinance of the City of Effingham - Brian Meyers - Rezone from B-2 General Commercial District to R-4 Limited Office and Retail District - 605 W. Jefferson Avenue - City Planner Koester

Motion to pass by Commissioner Moeller, second by Commissioner Micenheimer

4.3 Resolution No. 101-2023, A Resolution Accepting Proposal for Emergency Generator Maintenance - City Engineer Thoele

Public Works Director Heuerman stated this resolution authorizes execution of proposal from Fabick Power System, INC. in the total amount of $13,230.00 for Emergency Generator Maintenance. Payment for the three-year contract will be made from the General Fund, Sewer Fund, and Water Fund.

4.4 Resolution No. 105-2023, A Resolution Approving Preliminary Plat No. 863 - P and Approving Final Plat No. 863 - F for Recording - Conant Subdivision - City Planner Koester

4.5 Resolution No. 106-2023, A Resolution Supporting the FY 23 Rural Surface Transportation Grant Program Application - Public Works Director Heuerman

Public Works Director Heuerman stated this resolution supports the FY 2023 Rural Surface Transportation Grant Program Application. The City will apply for a $7,811,509 grant and will further support the project application by providing a local match of $1,562,301.80 (20%) if the award is granted.

4.6 2023 City Hall Fire Protection - Change Order 1 - Public Works Director Heuerman

Public Works Director Heuerman stated Change Order No. 1 in the total amount of $80,278.00 is recommended for the 2023 City Hall Fire Protection Project.

6. DISCUSSION

6.1 Ordinance No. 052-2023, An Ordinance Amending Division 10, Sections 2-425.14 (Personnel Policies and Procedures) of the Municipal Code of the City of Effingham, Illinois - Deputy City Administrator Presley

Deputy City Administrator Presley stated this ordinance amends the City's Personnel Policies and Procedures pertaining to computer and internet policy, establishing a policy to mitigate potential fraud to electronic funds transfers (EFTs).

There were no objections to bring this item back to a future City Council Meeting.

6.2 Resolution No. 103-2023, Resolution Authorizing Second Amendment to Contract for Private Development Pursuant to the Effingham. Illinois Plan for the Tax Increment Finance Area No. 1 (EBS Development, LLC) - Economic Development Director Hull

Economic Development Director Hull stated this amendment will allow additional time for project completion.

There were no objections to bring this item back to a future City Council Meeting.

6.3 Resolution No. 104-2023, A Resolution Authorizing a Supplemental Agreement for School District Work - Police Chief McFarland

Police Chief McFarland stated this is a supplemental agreement to the collective bargaining agreement between the Illinois FOP Labor Council and Fraternal Order of Police, Effingham Lodge #209 and the City of Effingham.

There were no objections to bring this item back to a future City Council Meeting.

6.4 DCEO Public Infrastructure Grant Award - City Engineer Thoele

Public Works Director Heuerman announced DCEO Awarded the Public Infrastructure Grant to the City of Effingham in the amount of $1,275,000.

6.5 Plan Commission Letter of Recommendation - Rezone 800 S. Fifth Street from R-2 to R 3D - City Planner Koester

City Planner Koester stated the Plan Commission unanimously recommended the petition to rezone 800 S. Fifth Street from R-2 to R-3D be denied. The Plan Commission's findings as provided in the Letter of Recommendation stated the trend of development in the area continues to single-family residences and the was not in conformance with the Comprehensive Plan. The Plan Commission did indicate a more restrictive zoning district may be more appropriate.

Public Works Director Heuerman provided information regarding a program with Ameren and public building energy consumption that will result in a cost savings for the City.

Economic Development Director Hull provided an update on two housing projects and the RISE Grant.

Tourism Director Thoele announced they would be setting up a grant program for the upcoming solar eclipse event.

City Planner Koester stated Plan Commission and Zoning Board of Appeals training would be happening soon.
