City of Olney Board of Appeals met June 6.

Here are the minutes provided by the board:

AGENDA #1 “CALL TO ORDER” The June 6, 2022, meeting of the Board of Appeals was called to order at 7:06 p.m. in the Council Chambers of the Olney City Hall, 300 S. Whittle Avenue, Olney, Illinois, with Tony Zuber presiding.

AGENDA #2 “ROLL CALL” The following Board of Appeals members were present: Kurt Ginder, Scott Jones, Bridgett Jensen, Samantha Brazil, Pat Everette, and Tony Zuber. David Abell was absent. Also present were Code Enforcement Officer Dallas Colwell and City Clerk Kelsie Sterchi.

AGENDA #3 “APPROVE MINUTES OF THE BOARD OF APPEALS MEETING ON MAY 2, 2022” Mr. Everette moved to approve the minutes from May 2, 2022, seconded by Mr. Ginder. Mr. Ginder, Mr. Jones, Mrs. Jensen, Mrs. Brazil, Mr. Everette, and Mr. Zuber voted yes. There were no opposing votes. The motion carried.

AGENDA #4 “SWEARING IN” Mr. Zuber asked that anyone wishing to testify on behalf of the items being discussed to stand and be sworn in. City Clerk Sterchi asked the individual to stand, raise their right hand, and “swear to tell the truth, the whole truth and nothing but the truth so help me God.” Julie Brooks was sworn in.

AGENDA #5 “VARIANCE: 315 N. SYCAMORE STREET” Tony and Julie Brooks had submitted Requests for Variation for 315 N. Sycamore Street, Olney, Illinois, Property Index Number 06-34-403-037. The petitioners were requesting a variance in the side yard setback to allow for a 2-foot setback rather than the 3-foot side yard setback required, and a variance in the distance from main building to allow for a 5.5-foot distance rather than the 10-foot distance required in Title 17 (Zoning) of the City of Olney Municipal Code. The granting of the variances would allow the petitioners to build a garage.

Mr. Everette asked if any neighbors were opposed to the request. Mrs. Brooks replied that no neighbors were in opposition. The City Clerk also had not received any correspondence in favor or in opposition of the request.

Mr. Zuber asked Mr. Colwell if he saw any issues with the request. Mr. Colwell had no issues. He explained to the Board that the reason the Code required a 10-foot distance from main buildings was due to fire safety. In this situation, because the neighborhood was so old and the property lines so tight, there was no other location on the property that would accommodate a garage. He believed the request for variance was justifiable.

The Board agreed that the variance would not adversely affect the neighborhood, that the general public’s safety and welfare would not be harmed, that the variance would allow the owners to have the best use of the property, that the variance would increase the property values and conform with the neighborhood, and that the public at large would see no gain or loss from the granting of the variance.

Mr. Jones moved to approve a 2-foot side yard setback and a 5.5-distance from main building for 315 N. Sycamore Street, seconded by Mr. Everette. Mr. Ginder, Mr. Jones, Mrs. Jensen, Mrs. Brazil, Mr. Everette, and Mr. Zuber voted yes. There were no opposing votes. The motion carried.

AGENDA #6 “PUBLIC COMMENTS/PRESENTATIONS” No one from the public wished to speak.

AGENDA #7 “ADJOURN” Mr. Jones moved to adjourn, seconded by Mrs. Brazil. Mr. Ginder, Mr. Jones, Mrs. Jensen, Mrs. Brazil, Mr. Everette, and Mr. Zuber voted yes. There were no opposing votes. The motion carried.

The meeting of the Board of Appeals adjourned at 7:09 p.m.
