City of Martinsville City Council met Jan. 12

Here is the minutes provided by the council:

*The meeting was called to order by Mayor Davidson, Alderman Lovell opened the meeting with prayer and all in attendance recited the “Pledge of Allegiance”. Roll call was answered by the following council members and elected officials: Chris Davidson, Chris Perry, Melinda Lovell and John Skinner with Troy

Propst and Preston Rukes absent. Also, in attendance were Mayor Herman Davidson, Clerk Marlene Wilhoit, Treasurer Terri Connelly and attorney Richard Bernardoni. Employees and citizens in attendance are attached to the back of the minutes.

PUBLIC COMMENTS:

Doug Haddix and Tony Davis addressed council with proposal to design and clear a path on city property east from the ball fields on East Kendall running east, north and back west through the wooded area to allow bicycles to ride a trail or even walkers. It would not be made for 4 wheelers or side by sides. They said it would be a ride at own risk. Insurance liability was brought up and they said other places that have them like Mill Creek just have a rider attached to their insurance to protect them from liability. The Council will make a motion to authorize this venture at the next council meeting.

*Motion by C Davidson 2nd by J Skinner to approve minutes of council meeting from 12-09-2020 and Utility Committee meeting from 01/08/2021

Upon roll call vote all alderman present voted for the motion (4)

*Motion by C Davidson 2nd by C Perry to approve the Treasurer’s report for December 2020 as presented. Upon roll call vote all alderman present voted for the motion (4)

*Motion by C Davidson 2nd by M Lovell to approve December 2020 bills payable January 2021 in the amount of $81,924.04.

Upon roll call vote all alderman present voted for the motion (4)

*Motion by M Lovell 2nd by C Davidson to approved the revised copy of Stipulated Agreement 2076 concerning safety improvements at the Union Street railroad crossing of CSX tracks for installation of crossing arms.

Upon roll call vote all alderman present voted for the motion (4)

*Motion by C Davidson 2nd by M Lovell to accept the proposal from Watt’s Copy Systems to replace the existing copier and maintenance agreement for a cost of $58.73 per month.

Upon roll call vote all alderman present voted for the motion (4)

*Motion by C Davidson 2nd by J Skinner to approve Ordinance No. 2021-01-1 titled: “An Ordinance to Approve the Editing and Inclusion of Certain Ordinances as Parts of the Various Component Codes of the Codified Ordinances”.

Upon roll call vote all alderman present voted for the motion (4)

COUNCIL COMMENTS:

* discussed garbage contract and how they would like to bid a contract including with and without toters supplied, what day for pick up, starting time of pickups, two clean ups per year with dumpsters located on the hill

*discussed possibly appointing someone to serve warnings on ordinance violations and if nothing is done and tickets need issued, they would come from the police

*discussed harvesting mature trees on city property for profit as two different contracts one for hardwood and one for softwood. The attorney will draw up a bid notice for the papers

*discussed the culvert on the north side of Ridgelawn Road where it crosses Route 40; it needs replaced and State Highway is saying it is ours to maintain but we are questioning the right of way. Mayor will contact County Highway engineer again

*Truelove has done an impressive job on property at west end of Cumberland Street since last meeting and after Attorney contacted Trueloves attorney. Old building is still standing and is to be removed.

With no other comments:

**Motion by C Davidson 2nd by C Perry to adjourn the meeting @ 8:25 PM.

All council members present voted for the motion. (4)
