Effingham County Board Legislative Committee of the Whole met November 13

Effingham County Board Legislative Committee of the Whole met Nov. 13.

Here is the minutes provided by the committee:

Committee Members Present: J Simpson, J Niemann, L Foster, D Campbell, J Perry, D McCain, R Arnold and J Thoele

This meeting called to order by Chair Jeff Simpson

1) Member L Foster motioned to approve the minutes of the October 16, 2019 meeting of this committee. Member J Niemann seconded. Motion carried.

2) Unfinished Business

• ATV, UTV, Golf Cart Ordinance 

Member D Campbell has requested and reviewed ordinances from counties who allow off-road vehicles on county highways. After discussion on this issue Committee Chair R Arnold appointed a committee to review further this issue. Members appointed are Rob Arnold, Joe Thoele, Doug McCain and David Campbell.

3) New Business

• Resolution to Authorize Smartwatt Agreement 

There are four options of energy updates for county buildings presented to the County Board by Smartwatt with varying monetary costs to the county. Member R Arnold motioned to send to the Full Board at its meeting of November 18, 2019 the recommendation to approve Option #4 which is a $0 contribution for the County. Member L Foster seconded. Motion carried. Member J Niemann motioned to send to the Full Board a recommendation to approve the resolution as presented. Member J Thoele seconded. Motion carried.

• MOU with Dive Rescue 

Committee Members believe a MOU isn't needed as Dive Rescue is not another governmental entity. Member R Arnold suggests this issue should be held over for discussion in order for everyone to understand it. Member J Perry motioned to send the MOU issue to the Public Safety Committee for review. Member L Foster seconded. Motion carried. 

Member J Niemann motioned to send the Dive Rescue MOU issue to the Full Board at its Special Meeting called for November 26, 2019. Motion carried.

• Support of Illinois Oil and Gas Industry Resolution 

This is a non-binding resolution that was sent to the County from the Illinois Petroleum Resources Board asking for support from the County Board. Member J Niemann motioned to send to the Full Board the recommendation to support this resolution. Member J Perry seconded. Motion carried.

• State's Attorney Appellate Prosecutor Resolution 

Member R Arnold motioned to send to the Full Board a recommendation to approve the Resolution to Participate in the Appellate Prosecutor Program for FY20. Member D Campbell seconded. Motion carried.

• Countywide Zoning Discussion 

After much discussion on this issue it was decided that Member D Campbell will do more research on what areas should be zoned by the County. Member J Niemann motioned to table this item to the December 9, 2019 meeting of this committee. Member J Perry seconded. Motion carried.

• Update of County Employee Handbook 

Member D Campbell motioned to table this issue to the December 9, 2019 meeting of this committee for further review. Member J Niemann seconded. Motion carried.

4) Appointments

• Member J Perry motioned to vote on both presented appointments together. Member L Foster seconded. Motion carried.

• Member J Perry motioned to send to the Full Board a recommendation of approval of the appointments presented - David Budde and Robert Tutko to the Effingham County Emergency Telephone System Board. Member L Foster seconded. Motion carried.

5) General Information/Public Comment - NONE

6) Closed Session - Personnel

• Member L Foster motioned to go into Closed Session to discuss Personnel. Member J Niemann seconded, Motion carried on a roll call with all members voting in the affirmative.

7) Member J Perry motioned to adjourn this meeting. Member D McCain seconded. Motion carried.
