Village of Montgomery Board of Trustees met Oct. 13.

Here are the minutes provided by the board:

I. President Brolley called the meeting to order at 7:00 p.m. followed by the Pledge of Allegiance.

II. Roll Call

Also present: Village Administrator Jeff Zoephel, Assistant Administrator Meghan Ostreko, Attorney Matt Walters, Engineer Chris Ott, Director of Public Works Mark Wolf, Director of Finance Chris Minick, Chief of Police Phil Smith and guests.

III. Public Participation

A. Public Comment – None.

B. Proclamation for Breast Cancer Awareness Month – President Brolley announced this item would be moved to the next meeting.

IV. Consent Agenda

A. Minutes of the September 22, 2025 Village Board Meeting

B. Accounts Payable Summary Report through October 13, 2025, in the Amount of $7,168,063.57

C. Community Development Report for September 2025

D. Water Production Report for September 2025

Trustee Brzoska moved to approve Items A-D of the Consent Agenda, seconded by Trustee Jungermann.

5 Yea. 0 No. Motion carried. Trustee Jungermann, Trustee Marecek, Trustee Brzoska, Trustee Gier and Trustee Bauman voting yea.

V. Items for Separate Action

A. Ordinance 2151 Disconnecting Territory from the Village of Montgomery Jericho Road - (Waiver of First and Passage on Second Reading)

Administrator Zoephel explained this is a housekeeping item due to disconnection of property.

Trustee Jungermann moved to approve Ordinance 2151 Disconnecting Territory from the Village of Montgomery Jericho Road - (Waiver of First and Passage on Second Reading), seconded by Trustee Marecek.

5 Yea. 0 No. Motion carried. Trustee Marecek, Trustee Brzoska, Trustee Gier, Trustee Bauman and Trustee Jungermann voting yea.

B. Recommendation of the Planning and Zoning Commission on PZC 2025-018, Variation 420 N Main, LLC

Administrator Zoephel said the petitioner wants a variance to construct a loading dock on the corner side yard. The PZC recommended approval with conditions; they have some concerns whether it fits with the Village’s goals for the downtown.

Trustee Marecek moved to approve Recommendation of the Planning and Zoning Commission on PZC 2025- 018, Variation 420 N Main, LLC, seconded by Trustee Jungermann.

5 Yea. 0 No. Motion carried. Trustee Marecek, Trustee Brzoska, Trustee Gier, Trustee Bauman and Trustee Jungermann voting yea.

C. Ordinance 2152 Granting a Variation on Zoning Requirements for an Off-Street Loading Facility - 420 N. Main St. (First Reading)

Trustee Gier said he is against this. He feels it is not good for the neighborhood and does not fit the plan for downtown. He doesn’t want additional truck traffic in the area. Trustee Marecek agreed and said eight truck bays is a lot and doesn’t fit the vision that the Village Board has had for the past 12 years. President Brolley said in the downtown there are different uses that coexist, and it would greatly impact the homeowners in the area.

Trustee Marecek moved to waive First Reading and approve Ordinance 2152 Granting a Variation on Zoning Requirements for an Off-Street Loading Facility - 420 N. Main St., seconded by Trustee Gier.

0 Yea. 5 No. Motion failed. Trustee Marecek, Trustee Brzoska, Trustee Gier, Trustee Bauman and Trustee Jungermann voting no.

VII. New or Unfinished Business

Trustee Brzoska said they need volunteers on October 22nd for the Halloween Decorations judging. Meet at 5:30 pm at Public Works. Trustee Marecek reminded everyone about the Fall Carnival this weekend with the Halloween Safety Event this Saturday from 10-2, which is always a great event.

Trustee Bauman mentioned he has noticed a lot of garbage bins in the street lately and asked what the regulation is regarding this. Director Wolf clarified that bins should be at the end of the driveway or on the parkway. He said the Village could put a reminder in the newsletter. Trustee Jungermann suggested he remind the waste haulers to replace the bins behind the curbline after emptying them also.
