Village of Dieterich Village Board met June 15.

The Dieterich Village Board met in regular session on Monday, June 15, 2020 at 6:30 PM at the Dieterich Civic Center.
The meeting was called to order by President Brad Hardiek and the Pledge of Allegiance was recited.
The following Trustees were present: Carrie Galbraith; Derick Stumeier and Mike French. Trustees Bill Lane and Jeff White were present electronically via speakerphone and Trustee Sean Pankau was absent. With five Trustees and President Hardiek in attendance, a quorum was declared to be present. Also at the meeting were Clerk Brittny Gipson, Mike Campbell, Engineer Lee Beckman, Donnie Dill, Nick Fewkes, Stan Russell, John Wright, Tammy Wright and Herb Meeker.
A motion was made by Trustee M. French; seconded by Trustee D. Stumeier to approve the Omnibus agenda: approve minutes of the July 6, 2020 regular meeting. Roll call was 5 yes and 0 no.
Village Maintenance Employee, Mike Campbell, had no updates to give.
A motion was made by Trustee M. French; seconded by Trustee B. Lane to approve Pay Estimate #3 for Kieffer Brothers Construction Company for $80,637.56 for water and sewer infrastructure construction in Dieterich Industrial Park East. Roll call was 5 yes and 0 no.
A motion was made by Trustee M. French; seconded by Trustee C. Galbraith to approve Ordinance 1037-2020: Amending the Village of Dieterich Personnel Policies and Procedures (Harassment Policy). Roll call was 5 yes and 0 no.
A motion was made by Trustee D. Stumeier; seconded by Trustee C. Galbraith to approve Ordinance 1038-2020: Authorizing the Purchase of Easement for Sanitary Sewer Purposes (Richard B. Coleman and Shelia M. Coleman – Benefit of Dieterich Industrial Park East). Roll call was 5 yes and 0 no.
A motion was made by Trustee M. French; seconded by Trustee B. Lane to approve Resolution 497-2020: Approving Preliminary Plat and Final Plat for Recording – Dieterich Bank Subdivision. Roll call was 5 yes and 0 no.
A motion was made by Trustee D. Stumeier; seconded by Trustee M. French to approve Resolution 498-2020: Approving Preliminary Plat and Final Plat for Recording – Kluthe Subdivision. Roll call was 5 yes and 0 no.
A motion was made by Trustee M. French; seconded by Trustee D. Stumeier to approve Resolution 499-2020: Approving Preliminary Plat and Final Plat for Recording – J.W. Horn’s First Addition. Roll call was 5 yes and 0 no.
Several Dieterich residents were present for the Public Comments portion of the meeting. There was a large rain event late in the evening on Sunday, July 19, 2020. Most rain gauges in Dieterich showed between 5” and 6.5” of rain in a 2-3 hour time frame and flooding happened at multiple residences. This amount of rainfall exceeded the 100-year rain event statistics set for Dieterich.
John and Tammy Wright have lived in Dieterich for 30 years, and this is the second time their walkout basement has flooded in a one-year time period. The first time it flooded was in August 2019. They feel something with the direction of water flow has changed in Dieterich to bring more water from the fields west of town towards S. Roman Drive. All of the water from the fields went over S. Roman Drive, which is a very rare occurrence, even with a 100-year rain event. The culvert that John Wright and Perry Price paid to have installed in their ditch north of Perry’s home has been acting as detention in Perry’s pasture during heavy rain events. John said he watched as the water topped their culvert and came rushing like a tidal wave towards his ditch and then into his walkout basement. Discussions proceeded with the Board and Village Engineer Lee Beckman about next steps to determine if and how the water flow has changed from the west and possible solutions to allow for more detention and for larger volumes of water to be allowed to flow under Section Street.
Resident Donnie Dill wanted the Board to be aware of the potential safety issues with the amount of water that was flowing over Village streets and through Liberty Park.
Resident Stan Russell reported that water was chest high in his rear yard, which is adjacent to the east side of the Dieterich Creek. He had 2’ of water in his detached garage and water filled his crawl space in his home and ruined his new HVAC duct work. He has concerns about the new Dieterich Industrial Park East storm water runoff creating more flow into the Dieterich Creek, creating more potential flooding downstream at his residence. Engineer Beckman stated that with the requirement of a storm water detention study and water detention, if needed, for each new development in Dieterich Industrial Park East, additional storm water to the Dieterich Creek should not negatively affect residents down stream. Stan and neighbor Nick Fewkes asked the Board to do something to help fix the flooding. The Board explained that we have been in the process for 5 years trying to straighten the oxbow in the Dieterich Creek at Virginia Street and still are waiting for Army Corps of Engineers approval.
Stan also talked about his current pending fines for his nuisance ordinance violations and explained why he accumulates such a large quantity of car parts on his property. He doesn’t feel that his selling of extra car parts on Facebook qualifies him for operating a business in a residential area. He only sells parts that are not needed from his demo derby parts, which is a hobby.
At 8:04 PM a motion was made by Trustee M. French; seconded by Trustee D. Stumeier to go into Closed Executive Session to discuss a land sale pursuant to 5 ILCS 120 Section 2(c) (6). Roll call was 5 yes and 0 no.
At 8:49 PM the Board returned from Closed Execution Session. Trustees present were Carrie Galbraith, Derick Stumeier and Mike French. Trustees Bill Lane and Jeff White were present electronically via speakerphone and Trustee Sean Pankau was absent. With five Trustees and President Hardiek in attendance, a quorum was declared to be present. Also in attendance was Clerk Brittny Gipson.
At 8:50 PM a motion was made by Trustee D. Stumeier; seconded by Trustee C. Galbraith to adjourn the meeting. Roll call was 5 yes and 0 no.
