Resolution No. 122-2017, Resolution Authorizing Acceptance of Proposal of RJN Group Inc. for Flow Monitoring - Adopt

(This is to determine existing sanitary flow through an existing lift station in the area near the intersection of West Rickelman Avenue and North Raney Street. The cost is $14,110 with payment to be made from the Capital Projects Account with funding from Sewer. This item was previously discussed.)

(This Resolution was discussed at the September 5th Council Meeting.)

Resolution No. 127-2017, Resolution Amending an Intergovernmental Agreement with Effingham Community Unit District No. 40 - Adopt

(This Resolution amends an Intergovernmental Agreement with Unit 40. This agreement authorizes a TIF reimbursement of up to $200,000 over a two-year period for actual costs associated with vocational education in FY16 and FY17. Up to $100,000 will be paid out to Unit 40 in FY18 and up to $100,000 will be paid out to Unit 40 in FY19. This item was previously discussed at the September 5th City Council Meeting.)

Resolution No. 134-2017, Resolution Authorizing Execution of Traffic Signal Service Agreement with Bodine Electric - Adopt

(This is a renewal of the Traffic Signal Service Agreement with Bodine Electric.)

Resolution No. 135-2017, Resolution Changing Ordinance No. 64-2017 to Ordinance No. 85-2017 (Comprehensive Plan) - Adopt

(This Resolution renumbers the Ordinance Amending the Official Comprehensive Plan. Ordinance No. 64-2017 had previously been issued and approved. This will document the change to Ordinance No. 85-2017.)

Resolution No. 138-2017, Resolution Authorizing Acceptance of Proposal from Cummins Inc. for Generator Maintenance - Adopt

(Bids were received for the project with Cummins Inc. submitting the lowest bid of $10,080. This is a three year contract with the option to extend upon mutual terms. Payments will be made from the General Fund, Sewer and Water. This item was previously discussed.)

(John L. Lewis, LLC has completed the project at a final cost of $79,058.45. Request acceptance of the project and release of the bonding.)

Pavement Marking Program - Varsity Striping - Change Order No. 1 - Approve

(This change order in the amount of $27,008.52 adds an additional scope of services not included in the original contract.)

(The Effingham Plan Commission has submitted their recommendation to approve this Petition to Rezone properties at 505 West Shelby Avenue and 203 South Walnut Street from Class R-3D, Multiple Dwelling District, to Class B-2, General Commercial District.)

(The Plan Commission has recommended approval to allow dwellings on any floor above the first floor in B-1, Neighborhood Shopping District, and B-2, General Commercial District, as is already an allowable use in a B-3, Central Business District.)

7. Discussion and Approval: Ordinance No. 76-2017, An Ordinance Amending Appendix B of the Municipal Code of Effingham, Illinois (Amendments - Dwelling above first floor in B-1, B-2, and B-3 Districts)

(The Plan Commission has held a public hearing regarding this text amendment and has unanimously approved the Petition to allow dwellings above the first floor in B-1, Neighborhood Shopping District, and B-2, General Commercial District, as is allowable in B-3, Central Business District.)

8. Discussion and Approval: Ordinance No. 77-2017, An Ordinance Amending Ordinance No. 13-2012, An Ordinance Amending Chapter 4 of the Municipal Code of the City of Effingham, Illinois (Liquor Control)

(This Ordinance amends the Liquor Control Ordinance by creating a Class MT Liquor License - Movie Theater - Consumption Sales Only. This item was discussed previously at the September 5th City Council Meeting.)

9. Discussion and Approval: Ordinance No. 81-2017, An Ordinance Amending Ordinance No. 13-2012, An Ordinance Amending Chapter 4 of the Municipal Code of the City of Effingham, Illinois (Liquor Control)

(This Ordinance amends Ordinance No. 13-2012 to increase the Class MT (Movie Theater - Consumption Sales Only) from 0 to 1. This increase is subject to Village Square Mall Cinemas obtaining a Class MT Liquor License. This item was previously discussed at the September 5th City Council Meeting.)

10. Discussion and Approval: Resolution No. 139-2017, A Resolution Authorizing the Issuance of Liquor License to JAD Imports Inc. d/b/a Village Square Shopping Center

(This Resolution authorizes the issuance of a Class MT Liquor License to JAD Imports Inc. d/b/a Village Square Shopping Center.)

11. Discussion and Approval: Ordinance No. 83-2017, An Ordinance Amending the Fiscal Year 2018 Annual Operating Budget for the City of Effingham, Illinois, for the Fiscal Year Beginning May 1, 2017 and Ending April 30, 2018

(This Ordinance amends the FY18 Annual Operating Budget. This Ordinance captures grant revenue from thy Rail Road Grade Crossing Protection Fund (RRGCF) in the amount of $63,500 for the completion of the Haney Rail Road Crossing Project and increases the expenditures for this project in the same amount.)

12. Discussion and Approval: Ordinance No. 86-2017, An Ordinance Amending the Zoning Ordinance - Niebrugge A-1 Furniture

(After a public hearing, the Effingham Plan Commission has unanimously approved the rezoning of property at 505 West Shelby Avenue and 203 South Walnut Street from Class R-3D, Multiple Dwelling District, to Class B-2, General Commercial District.)

13. Discussion and Approval: Resolution No. 136-2017, A Resolution Authorizing the Execution of an Agreement With Economic Development Resources for an Amendment to the Ford Avenue Business District Plan

(This amendment of the Ford Avenue Business District will encompass the re-alignment of the District boundaries in regard to the Meijer Project and changes in project costs and the text of the plan. This agreement will replace an existing amendment agreement.)

14. Discussion and Approval: Resolution No. 137-2017, A Resolution Approving Preliminary Plat No. 768-P, Meijer Effingham Subdivision

(This is approval of the Preliminary Plat only. The Final Plat will be presented for approval at a later date. The proposed subdivision is for the new Meijer Store on Lot 1 and future development on the other 6 lots. The Plan Commission unanimously recommended approval of the Preliminary Plat.)

15. Discussion and Approval: Resolution No. 140-2017, Resolution Authorizing an Agreement with Emerald Data Solutions Inc., for BoardDocs Pro Software and Services

(The City's current document management and board/agenda software, SIRE technologies, has reached its end of life. City staff is recommending the purchase of the cloud-based software BoardDocs Pro to replace SIRE at an annual cost of $10,000. Payment will be made from General, TIF, Tourism, Water and Sewer Funds.)

16. Discussion: Ordinance No. 82-2107, An Ordinance Amending Ordinance No. 13-2012, An Ordinance Amending Chapter 4 of the Municipal Code of the City of Effingham, Illinois (Liquor Control)

(This Ordinance amends the City's Liquor Control Code to increase the Class R-1 Liquor Licenses from four to five. This increase is subject to the issuance of a liquor license to Lucky Dogs. Representatives from this proposed business will be present to address the Council.)

17. Discussion: Ordinance No. 87-2017, An Ordinance Amending Article II of Chapter Seven, Article IV of Chapter 7, and Articles II and V of Chapter 10 of the Municipal Code of Effingham, Illinois and Adopting by Reference Various Standard Codes

(This Ordinance updates the existing Building, Electrical, and Fire Codes by adopting by reference with various modifications the 2015 International Building Code, 2015 International Residential Code, 2008 NFPA 70 Electrical Code, 2015 International Fire Code, 2015 NFPA 101 Life Safety Code, and the 2012 NFPA 101 Life Safety Code.)

18. Discussion: Downtown/Southtown TIF Rehabilitation Program

(Gopher's Grill plans to do a rehabilitation project at their location of 206 W. Jefferson Avenue.)

19. Discussion: Hotel/Motel Redevelopment Program

(The Baymont Inn and Suites plans to rehabilitate the hotel)

20. Discussion: Redevelopment Agreement with Pro-Lube

(A rehabilitation project is being proposed for the Pro-Lube facility.)

21. Discussion: 1st Quarter Financial Report

(City Administrator Jim Arndt will provide the City Council with the 1st Quarter Financial Report for Fiscal Year 2018. The report will be placed on the City's website after the conclusion of this meeting.)
