4.1 Ordinance No. 017-2024, An Ordinance Amending Appendix B of the City of Effingham, Illinois Municipal Code (Zoning Ordinance No. 44-89) - Cryptocurrency Mine or Data Center - Article 1. Definitions - Article 26. Special Use Regulations - City Planner Koester

City Planner Koester stated this ordinance provides definitions and regulations for Cryptocurrency Mines and Data Centers. At a public hearing on March 12, 2024, the Plan Commission unanimously recommended the City Council adopt and enact the provisions in the text amendment.

Motion to pass by Commissioner Micenheimer, second by Commissioner Moeller Final Resolution: Motion Carried. 5-0

4.2 Ordinance No. 018-2024, An Ordinance Amending the Zoning Ordinance of the City of Effingham and Granting Special Use Permit - Meraki Health - Rezone from R-3B Two and Three Family Dwelling District to R-3D Multiple-Dwelling District and Special Use Permit (17) “Offices and clinics operated by physicians, dentists or other members of the healing arts in the R-3D District” - Blohm Avenue, East of Veterans Drive - City Planner Koester

City Planner Koester stated that at a public hearing on March 12, 2024, the seven Plan Commission members present voted unanimously to recommend the City Council approve the petition to rezone the subject property located on Blohm Avenue, east of Veterans Drive from R-3B Two and Three Family Dwelling District to R-3D Multiple-Dwelling District and grant a Special Use Permit (17) “Offices and clinics operated by physicians, dentists or other members of the healing arts in the R-3D District”. The Plan Commission also recommends two conditions to the Special Use: no residential development will be permitted and buffering as required by the City Engineer.

Sarah Weiler submitted a speaker’s card and presented to the council in favor of the rezoning.

Due to the availability of the letter of recommendation to the Council, this item was only discussed. Following discussion, it was decided to bring this item back at the next City Council Meeting under the Omnibus Vote Agenda.

4.3 Resolution No. 021-2024, A Resolution Authorizing Renewal of Contract with Lamar Companies for Champaign Billboard for the 2024 & 2025 Calendar Years - Tourism Director Thoele

Tourism Director Thoele stated this resolution authorizes the renewal of a contract with Lamar Co. for a Champaign billboard.

Motion to adopt by Commissioner Stephens, second by Commissioner Gillenwater Final Resolution: Motion Carried. 5-0

4.4 Resolution No. 022-2024, A Resolution Authorizing Renewal of Contract with Lamar Companies for Mt Vernon Billboard for the 2024 & 2025 Calendar Years - Tourism Director Thoele

Tourism Director Thoele stated this resolution authorizes the renewal of a contract with Lamar Co. for the Mt Vernon billboard.

4.6 Resolution No. 024-2024, A Resolution Authorizing Certificate of Authority by Vote - Public Works Director Heuerman

Public Works Director Heuerman stated this resolution authorizes certain city staff members to enter into an agreement for the solicitation for the CY2024-CY2025 Joint Purchase Master Contracts for Rock Salt.

6. DISCUSSION

6.1 Ordinance No. 011-2024 - An Ordinance Amending Ordinance Nos. 17-2010, As Previously Amended by Ordinance Nos. 14-2012, 18-2020, and 038-2020 (Fourth Amendment to Master Lease Agreement) - Deputy City Administrator Presley

Deputy City Administrator Presley stated this fourth amendment to the master lease between the City and the Arts Connection of Central Illinois revises policies pertaining to insurance coverage of the Effingham Performance Center.

There were no objections to bring this item back to a future City Council Meeting.

6.2 Ordinance No. 014-2024, Fiscal Year 2025 Appointment Ordinance - City Administrator Miller

Deputy City Administrator Presley stated this ordinance authorizes the appointment of those staff members who are appointed on yearly terms and authorizes the numbers of staff by position category in all departments of the City.

There were no objections to bring this back to a future City Council Meeting.

6.3 Ordinance No. 015-2024, An Ordinance Establishing Pay Ranges for the Various Non Union Salaried and Hourly Positions Within the Service of the City for Fiscal Year 2024- 2025 - City Administrator Miller

City Administrator Miller stated this ordinance establishes a three percent (3%) salary increase for non-union personnel.

There were no objections to bring this item back to a future City Council Meeting.

6.4 An Ordinance Amending the Zoning Ordinance of the City of Effingham - W Squared Properties, LLC R-2 Single-Family Residence District to R-3B Two and Three Family Dwelling District - 909 W. St. Anthony Avenue - City Planner Koester

City Planner Koester stated that at a Public Hearing on March 12, 2024, seven of the nine Plan Commission members present voted five to two to recommend the City Council deny the petition to rezone the subject property located at 909 W. St. Anthony Avenue, from R-2 Single-Family Residence District to R-3B Two and Three Family Dwelling District.

Brad Hibdon submitted a Speaker's Card and spoke in favor of denying the rezoning.

Bryan Wenthe submitted a Speaker's Card and spoke in favor of approving the rezoning. Wenthe requested the item be sent back to the Plan Commission with additional information provided.

The City Council agreed to send this item back to the Plan Commission.

6.5 Resolution No. 020-2024, A Resolution Accepting Chemical Quotes for FY 2024-2025 - Public Works Director Heuerman

Public Works Director Heuerman stated this resolution accepts chemical quotes for FY 2024-2025 for the Water Treatment Plant from the responsive vendors shown in Exhibit A. Payment for said chemicals will be made from the Water Fund as per the FY 2024-2025 budget.

There were no objections to bring this item back to a future City Council Meeting.
