City of Mattoon City Council met July 7.

Here is the minutes provided by the council:

The City Council of the City of Mattoon held a Regular City Council meeting in the Council Chambers of City Hall.

Mayor Pro-Tem Owen presided and called the meeting to order at 6:30 p.m.

The following members of the Council answered roll call physically present: Absent Commissioner Dave Cox, YEA Commissioner Sandra Graven, YEA Commissioner Rick Hall, YEA Mayor Pro-Tem Preston Owen, and Absent Mayor Tim Gover.

Also physically present were City personnel: City Administrator Kyle Gill, City Attorney Daniel C. Jones, Finance Director/Treasurer Beth Wright, Arts & Tourism Director Angelia Burgett- Audio, Public Works Director Dean Barber – Audio, Police Chief Jason Taylor and City Clerk Susan O’Brien.

CONSENT AGENDA

Mayor Pro-Tem Owen seconded by Commissioner Hall moved to approve the consent agenda consisting of minutes of the regular meeting June 16 & special meetings June 18, 2020; bills and payroll for the last half of June, 2020.

Mayor Pro-Tem Owen declared the motion to approve the consent agenda carried by the following vote: Absent Commissioner Cox, YEA Commissioner Graven, YEA Commissioner Hall, YEA Mayor Pro-Tem Owen, and Absent Mayor Gover.

PRESENTATIONS, PETITIONS AND COMMUNICATIONS

Mayor Pro-Tem Owen opened the floor for Public comments, both in person and virtually, with no response.

NEW BUSINESS

Commissioner Graven seconded by Commissioner Hall moved to adopt Special Ordinance No. 2020-1744, approving a permanent easement to run along the north side of the bridge carrying CR1300N over Lake Mattoon for the Lake Mattoon Public Water District.

SPECIAL ORDINANCE NO. 2020-1744

AN ORDINANCE APPROVING A PERMANENT EASEMENT FOR THE LAKE MATTOON PUBLIC WATER DISTRICT

WHEREAS, the City of Mattoon owns and maintains Lake Mattoon in Coles, Cumberland, and Shelby Counties; and

WHEREAS, the Cumberland County Highway Department owns and maintains County Road 1300 North (CR1300N), and the bridge carrying CR1300N over Lake Mattoon; and

WHEREAS, the Lake Mattoon Public Water District owns and maintains a potable water main along CR1300N, and attached to the bridge carrying CR1300N over Lake Mattoon; and

WHEREAS, the Cumberland County Highway Department is preparing to reconstruct the bridge carrying CR1300N over Lake Mattoon; and

WHEREAS, the Lake Mattoon Public Water District is preparing to bore a new water main under Lake Mattoon along the north side of the bridge carrying CR1300N over Lake Mattoon as part of said construction project; and

WHEREAS, the Lake Mattoon Public Water District is requesting a Permanent Easement from the City of Mattoon for the construction and maintenance of the new water main under Lake Mattoon along the north side of the bridge carrying CR1300N over Lake Mattoon.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MATTOON, COLES COUNTY, ILLINOIS, that:

Section 1. The attached Permanent Easement for Lake Mattoon Water District be approved.

Section 2. This ordinance shall be deemed published as of the day of its adoption and approval by the City Council.

Section 3. This ordinance shall be effective upon its approval as provided by law.

Upon motion by Commissioner Graven, seconded by Commissioner Hall, adopted this 7th day of July , 2020, by a roll call vote, as follows:

Mayor Pro-Tem Owen seconded by Commissioner Graven moved to approve Council Decision Request 2020-2056, accepting the bid in the amount of 4.19¢/kW*hr. from Energy Harbor for the Electrical Supply for residential users in the City of Mattoon.

RESOLUTION NO. 2020-3096

DECLARATION OF LOCAL STATE OF EMERGENCY

State of Illinois

County of Coles

City of Mattoon

Pursuant to the authority vested in the office of Mayor by the Illinois Municipal Code Section 5/11-1-6, the Illinois Emergency Management Agency Act Section 3305/11 and Ordinance No. 2020-5430 of the City of Mattoon, I, J. Preston Owen, the Mayor Pro-Tem of the City of Mattoon do hereby declare that a Local State of Emergency exists as of this date, July 07, 2020, and shall continue until such time as provided in Ordinance No. 2020-5430.

WHEREAS, on January 30, 2020, the World Health Organization declared the outbreak of COVID-19 to be a public health emergency of international concern and on March 11, 2020 declared a worldwide pandemic; and

WHEREAS, on January 31, 2020, the U.S. Health and Human Services Secretary declared a public health emergency for the United States; and

WHEREAS, the Governor of the State of Illinois has issued a disaster proclamation on March 9, 2020 due to the impact of the COVID-19 virus and has activated the State Emergency Operations Center; and

WHEREAS, the State Emergency Management Agency has declared a public health emergency due to the impact of the COVID-19 virus; and

WHEREAS, the City Administration has coordinated its response with other Coles County governmental entities.

The nature of the emergency is related to the COVID-19 virus which is causing or anticipated to cause widespread impacts on the health of members of the community.

During the existence of the Local State of Emergency, the Mayor shall execute such authority as provided under the Illinois Municipal Code, the Illinois Emergency Management Agency Act and Ordinance No. 2020-5430.

This Declaration of Local State of Emergency shall be filed with the City Clerk as soon as practicable.

I, J. Preston Owen, whose name is signed to this instrument, being first duly sworn, signed and executed the instrument as the Declaration of Local State of Emergency, and that I signed willingly, and that I executed it as my free and voluntary act for the purposes therein expressed.

DEPARTMENT REPORTS:

CITY ADMINISTRATOR/COMMUNITY DEVELOPMENT noted the three purchasing motions delayed due to 4/5ths approval which would be considered at the July 10th Special Meeting; progress of union negotiations, cell tower inquiry, and Community Development Department selling many fence and pool permits. Mayor Pro-Tem Owen opened the floor for questions with no response.

CITY ATTORNEY noted normal business and city court. Mayor Pro-Tem Owen opened the floor for questions with no response.

CITY CLERK noted completing the City Audit requests, processing the State of Illinois Public Safety Employee Benefits Act (PSEBA) Employer Response & Recipient Responses; receiving notice from the Illinois Department of Insurance’s announcement of the State audit of the Fire Pension Fund and preparing for that audit, and attending a meeting with Kyle and our insurance broker to discuss a health insurance option (a presentation to be place on the 21st agenda); otherwise, business as usual. Mayor ProTem Owen opened the floor for questions with no response.

FINANCE distributed and reviewed the revenue tracking report, noting the differences in property taxes and utility taxes with the majority of the property taxes distributed to the Library, and Fire and Police Pension Funds. The unrestricted cash was noted approximately $4.75 million compared to last month at $4.6 million. Mayor Pro-Tem Owen discussed the revenues. Mayor Pro-Tem Owen opened the floor for questions with no response.

PUBLIC WORKS reviewed the progress of Marshall Avenue and utility conflicts resolved, Coles Centre contractor, Bike Trail and signage and DeWitt Avenue sidewalk ramps and patching by IDOT.

FIRE noted preparing for the State Fire Pension Audit, reported on June training, calls for service, new hire testing; and recognized Engineer/Driver Ronnie Spurgeon for receiving a letter nomination from the State Fire Marshal’s Office with gratitude and appreciation for his fire prevention and life safety.

Mayor Pro-Tem Owen opened the floor for questions. Commissioner Hall described Engineer Spurgeon as a good leader and appreciated his accomplishments.

POLICE requested additional personnel as one civilian and three uniform police officers due to upcoming retirements since the Department is not viable with manning less than four. Mayor Pro-Tem Owen opened the floor for questions with no response.

ARTS AND TOURISM announced positive feedback on Facebook regarding the Bike Trail, successful 4th of July parade with social distancing, upcoming virtual YMCA Run for the Bagel on July 18th, drive thru breakfast at Peterson Park for the Bagelfest, and Mural Artist arrival in mid-August.

COMMENTS BY THE COUNCIL

Mayor Pro-Tem Owen recognized the passing of former Mayor Wanda Ferguson; and complimented the Bike Trail as a nice addition. Commissioners Graven and Hall had no further comments.

Mayor Pro-Tem Owen seconded by Commissioner Graven moved to recess to closed session at 6:51 p.m. pursuant to the Illinois Open Meetings Act for the purpose of the collective negotiating matters between the City of Mattoon and its employees or their representatives, or deliberations concerning salary schedules for one or more classes of employees (5ILCS 120 (2)(C)(2)).

Council reconvened at 7:45 p.m.
