John Kraft of the Edgar County Watchdogs (ECW) has filed a second lawsuit claiming Freedom of Information Act (FOIA) violations by the City of Carlinville and FOIA officer Carla Brockmeier.
On the same day of the filing, July 11, the Illinois Attorney General's (AG) Public Access Bureau (PAB) issued a binding opinion that Carlinville and Brockmeier had violated Kraft's original FOIA seeking public records.
The City Council voted to provide the information Kraft requested, but Brockmeier and city attorney Daniel Schuering failed to provide the cell and smart phone records, credit and debit card statements and training certificates that were requested, Kraft said on the ECW website Illinois Leaks.

While Shuering told the assistant attorney general that he had provided the records to Kraft on April 7, Kraft never received the information, he contended. In addition, Shureing did not supply a copy of the supposed letter to the AAG, according to the ECW.
The attorney general's office determined that the city failed to respond to Kraft's FOIA request within five days, as required by law. The city has been ordered to comply with the binding order.
